The present contempt application has been preferred alleging violation of an order dated 11th December, 2020 passed by this Court in a writ petition being WPA 20386 of 2019. By the said order this Court directed the respondents to take appropriate steps towards disbursement of the arrear salary of the petitioner pertaining to the period from December, 2018 till December, 2020. The Court further directed the respondents to take all necessary steps to ensure that the petitioner gets his monthly salary on and from the month of December, 2020.
The petitioner appearing in person submits that that the school authorities preferred an appeal against the order dated 11th December, 2020 and even after dismissal of the same on 13th January, 2021, appropriate steps were not taken and the salary due and payable to the petitioner was illegally withheld.
2He further submits that an amount of Rs.2,76,572/- was due to him towards salary for the period from December, 2018 to December, 2020 but only an amount of Rs.8,08,488/- has been paid and that too belatedly. Such act constitutes deliberate violation of the Hon'ble Court's order. In spite of repeated representations, the respondents have not responded.
Mr. Ray, learned advocate appearing for the respondent nos.1 and 5 denies and disputes the contention of the petitioner and submits that on the basis of the requisition sent by the school, an amount of Rs. Rs.8,08,488/- has already been disbursed in favour of the petitioner and the order of this Court has been duly complied with.
He further submits that during pendency of the present contempt application, the petitioner has been transferred to a different school in the month of February, 2021. Let a compilation of documents, as filed, be kept on record. A copy of the same has been handed over to the petitioner.
Answering the query of this Court, the petitioner submits that his regular salary is being disbursed.
Heard the learned advocates appearing for the respective parties and considered the materials on record.
Pursuant to the order passed by this Court, the respondents have disbursed a amount of Rs. 3 8,08,488/- pertaining to the period from December, 2018 till December, 2020. During pendency of the contempt application, the petitioner has been transferred to another school in the month of February, 2021 and he is getting his regular salaries.
In the said conspectus, this Court is of the opinion that there has been no deliberate violation of the order and as such, the contempt application is dismissed.
The petitioner's claim that he is entitled to a much more amount than Rs.8,08,488/-, involves disputed questions of fact and the same cannot be decided in the present contempt application. However, the dismissal of the contempt application shall not prevent the petitioner from urging such issue before the appropriate forum, if so advised and in accordance with law. There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities.
