1. On 21st January 2026, the Court had passed the following order:
"1. Today, Mr. Bhuvan Singh, who appears on behalf of the Plaintiff is not present, Mr. Patel, who is here in person informs me that Mr. Singh had to travel outside Mumbai for personal work.
2 Mr. Kane submits that the Plaint has been amended and as per the order rd dated 3 December, 2025, the Affidavit-in-Reply of Controller of Patents is awaited.
3. On the next date, let the Controller be represented through Advocate, a copy of this order shall be intimated to the Controller.
4. Stand over to 4th February, 2026. High on Board."
2. Learned counsel has pointed out that, in compliance with the said order, they had intimated to the Controller. It is indeed most surprising that, despite the aforesaid order having been communicated to the Controller, the Controller is not represented before this Court, given the issue that arises for consideration before the Court.
3. Issue notice to the Controller, returnable on 18th February 2026.
