The defendants are before this Court against the judgments and decrees of the courts below, whereby the suit filed by the respondents/plaintiffs for possession by way of specific performance of agreement to sell, was decreed.
The judgment of the learned lower appellate court is dated 20.8.2011. Ever since the appeal has been filed in this Court, even without issuing notice of motion, the same is being adjourned in the absence or on request of counsel for the appellants. Today again, the case was taken up twice, however, none appeared for the appellants.
As no arguments on merits are addressed, the appeal is dismissed. For the purpose reference can be made to the judgment of Hon'ble the Supreme Court in Poonam v. Sumit Tanwar, 2010 (4) SCC 460.
