JUDGMENT
[W.P(C) Nos.3291, 4188 and 4991 of 2019] These three writ petitions pertain to the alleged recognition granted to various Yoga courses conducted by the 4th respondent in W.P(C)No.4991 of 2019. The petitioner in W.P(C)No.4991 of 2019 is stated to be the President of the Yoga Teachers Union.
2. The petitioner has filed the captioned writ petition, essentially contending that the Kerala Sports Council - the 3rd respondent herein - has quite arbitrarily sought to recognize various courses - certificate courses - conducted by the 4th respondent as a qualification required for appointment as Yoga instructors in the Local Self Government Institutions.
According to the petitioner, the 4th respondent is only a private organization, having commenced operations on 02.11.2016, as evidenced by Ext.P4 Certificate of Registration and the Sports Council has issued Ext.P6 only for favouring the afore organization. It is further contended that, within a period of W.P(C)Nos.3291, 4188 and 4991 of 2018 7 2025:KER:46223 one year from the date of commencement itself, the Sports Council has issued Ext.P7, acting on the basis of Ext.P6 Government Order recognizing the courses conducted by the 4th respondent. In such circumstances, the prayers raised in W.P (C)No.4991 of 2019 are as under :-
"i. To call for the records relating to Exhibit P6 order No.G.O(GEN)No.3190/2017 Local Self Government Administration Department dated 03.10.2017 and quash them by issuing by writ of certiorari or any other writ or order.
ii. Issuing a writ of mandamus or any writ order commanding respondent No.3 to cancel the recognition of the course of Certificate Course, Diploma Course in Yogic Science and other courses issued by the 4th respondent for the purpose of selecting instructors for training in sports Yoga and Yogic Science."

W.P(C)No.4188 of 2019 is a writ petition filed by another association, stated to have been engaged in the conduct of various courses imparting education in Yoga from 1988 onwards, seeking an appropriate direction to the Sports Council to affiliate the petitioner therein. 4. W.P(C)No.3291 of 2019 has been filed by yet another association, seeking to challenge Ext.P2 Government Order dated 03.10.2017, which is produced by the petitioner in W.P(C)No.4991 of 2019 as Ext.P6.

I have heard Sri.T.Asaf Ali, the learned counsel for the petitioner and Sri.K.B.Arun Kumar, the learned counsel for the 4th respondent in W.P(C)No.4991 of 2019, Sri.Vishak.K.Johnson, the learned counsel for the petitioner in W.P(C)No.4188 of 2019, Smt.Latha Anand, the learned counsel for the Kerala Sports Council, as well as Sri.E.G.Gorden, the learned Senior Government Pleader.
6. The challenge in W.P(C) No.4991 of 2019 and W.P(C)No.3291 of 2019, as already noticed, is essentially regarding the Government Order dated 03.10.2017. The afore order seeks to prescribe various qualifications for appointment as Yoga instructors in the Local Self Government Institutions.
A BNYS Degree or a similar degree obtained from a recognized University is stated as one of the required qualifications. At W.P(C)Nos.3291, 4188 and 4991 of 2018 9 2025:KER:46223 the same time, the afore Government Order also seeks to recognize the qualifications being granted by the 4th respondent herein, as well as the Kerala Sports Council, when steps are being taken by the Local Self Government Institutions for the appointment of Yoga Instructors. It is on the basis of Ext.P6 that Ext.P7 communication dated 14.01.2018 is issued by the Kerala Sports Council, seeking to approve the Diploma course being conducted by the 4th respondent Association. The petitioners in the other two writ petitions are essentially challenging the prescription of the qualification being granted by the 4th respondent herein as sufficient, as well as the approval of such qualification at the hands of the Kerala Sports Council.
7. In this connection, it is worthwhile to make reference to the various provisions of the Kerala Sports Act, 2000. The duties, powers, and functions of the Sports Council are prescribed with reference to the provisions of Section 5 thereunder. Subsection (2) thereto provides for the powers as W.P(C)Nos.3291, 4188 and 4991 of 2018 10 2025:KER:46223 well as the functions of the Sports Council. A perusal of the various provisions, under Section 5 (2), would show that the Sports Council can only organize, co-ordinate, regulate, and promote all types of sports in the State. The Sports Council under Clause (e) thereunder can confirm "titles" as well as issuance of "certificates" and award "prizes or scholarships or other benefits". The statute provides for recognition of a particular course being conducted by either a University or an independent association or an independent body. Unless and until the provisions of the statute specifically empower the Sports Council to act in a particular manner, I am of the opinion that the Sports Council cannot issue communication/notice in the nature of the one at Ext.P7 dated 03.10.2018. It is on the basis of the afore, that the ultimate challenge against the Government Order at Ext.P6 dated 03.10.2017 is to be noticed.
It is not in dispute that various other Universities in the State as well as outside the State are conducting courses in Yoga either as degree courses or as P.G. Diploma courses, as is W.P(C)Nos.3291, 4188 and 4991 of 2018 11 2025:KER:46223 evidenced from Ext.P3 and similar other curriculum relied on by the petitioner. As against the afore, this Court notices that the Government has sought to approve the afore degrees as a required qualification for seeking appointment as Yoga instructors in the Local Self Government Institutions. To that extent, the stand of the Government while issuing Ext.P6 cannot be said to be arbitrary.

At the same time, this Court notices that the Government in Ext.P6 has also sought to provide that if a person is obtaining a degree from the 4th respondent herein, that will also be considered as a relevant qualification for seeking appointment as Yoga instructors in the Local Self Government Institutions. No reasons are provided by the Government to equate the degrees obtained under the curriculum prescribed by the various Universities at par with the courses conducted by the 4th respondent. The Government, in my opinion, was not justified in prescribing that the courses offered by the 4th respondent would also be W.P(C)Nos.3291, 4188 and 4991 of 2018 12 2025:KER:46223 considered as a qualification entitling a person seeking appointment as a Yoga Instructor. Therefore, Ext.P6, to the extent of prescribing the afore as a required qualification, is also to be set aside.
9. The prayer in W.P(C)No.3291 of 2019, as already noticed, is for a direction to the Sports Council to affiliate the petitioner therein. At the same time, with respect to the provisions of the Kerala Sports Act, 2000, there cannot be any dispute to the fact that there can only be one affiliated association with respect to a particular sport in the State of Kerala. In the case at hand, as regards Yoga, the 4th respondent in W.P.(C)No.4991 of 2019 has been affiliated.
When that be so, the petitioner in W.P(C)No.4188 of 2019 is not justified in seeking a direction to the Sports Council to affiliate the said association also.
10. This Court in Kerala Cycle Polo Association, Thiruvananthapuram v. Union of India [2025 KHC OnLine 456], has already found that as regards a particular W.P(C)Nos.3291, 4188 and 4991 of 2018 13 2025:KER:46223 Sport, there can only be one association having recognition under the Sports Act in the State of Kerala. As regards the Sport of Yoga, as already noticed, insofar as the 4th respondent in W.P.(C)No.4991 of 2019 is already affiliated, the prayers in W.P(C) No.4188 of 2019 do not arise for consideration at all.
Resultantly, these writ petitions would stand disposed of as under:-
i. W.P(C)Nos.4991 of 2019 and 3291 of 2019 would stand allowed to the extent of setting aside that part of Government Order dated 03.10.2017, which seeks to prescribe the degrees being offered by the 4th respondent Association as a equivalent degree for appointments in the Local Self Government Institutions and setting aside Ext.P7 communication dated 14.01.2018 issued by the Sports Council approving the courses being conducted by the 4th respondent Association.
ii. W.P.(C)No.4188 of 2019 would stand dismissed. The W.P(C)Nos.3291, 4188 and 4991 of 2018 14 2025:KER:46223 learned counsel for the petitioner in the afore writ petition, however, points out that liberty may be granted to the petitioner therein to challenge the affiliation granted to the 4th respondent herein, appropriately.
iii. Taking note of the afore submission, the petitioner in W.P(C)No.4188 of 2019 is permitted to challenge the affiliation granted to the 4th respondent in W.P(C) No.4991 of 2019, in accordance with law.
