1. Petitioner has filed this second interim bail application under Section 439 of Cr.P.C. seeking interim bail for a period of one month on account of marriage of his younger brother.

2. F.I.R. No.210/2017 was registered at Police Station Laxmangarh, Sikar, for offence under Sections 147, 148, 149, 302, 341, 323, 427 of I.P.C.

3. Counsel for the complainant has opposed the second interim bail application. His contention is that on account of marriage of petitioner's brother, interim bail cannot be granted. The petitoner has brutally murdered an Army Personnel. From the Marriage invitation card, it is revealed that there are many family members. (Downloaded on 29/06/2019 at 12:08:10 AM)

4. Learned Public Prosecutor has opposed the second interim bail application. He informed the Court that the case pertains to murder of a neighbour and in case petitioner is given interim bail, there are chances of breach of peace.

5. I have considered the contentions.

6. In view of the fact that marriage of petitioner's brother is to be solemnized and there are many family members, I do not deem it proper to allow the interim bail application.

7. The second interim bail application is accordingly dismissed.
