Apartment Owners‟ Association, submits that talks of settlement are ongoing between the petitioner and the respondent.
Mr.Sandeep Aggarwal, Senior Advocate, enters appearance and submits that he is representing Mr.Anoop Sharma (earlier Vice President of the respondent), who has challenged the election of the new management of the respondent. He submits that in terms of the order dated 07.08.2018 passed in CM(M) 892/2018 titled Anoop Sharma v. Bhushan Kumar Narula & Ors and order dated 04.12.2018 in FAO 513/2018 titled Anoop Sharma v. Bhushan Kumar Narula & Ors., the present management of the respondent cannot enter into any settlement talks with the petitioner.
Mr.Rupesh Jain submits that these orders do not in any manner bar the present management to seek amicable settlement of the disputes with the petitioner.
In my opinion, the disputes between Mr.Anoop Sharma and the present management are not the subject matter of the dispute for the present petition and therefore, I cannot take any cognizance of the same. Mr.Anoop Sharma would be free to take appropriate order from the competent Court, if so advised. As far as the present petition is concerned, recording the submission of the learned counsel for the petitioner and Mr.Rupesh Jain that the parties are exploring the possibility of an amicable settlement, relist on 18th February, 2019.
