The anticipatory bail application filed on behalf of petitioner, namely, Dr. Neha Shandilya, who is apprehending her arrest in connection with Chutia PS Case No. 06 of 2020 for the offence registered under Sections 406 and 420 of the Indian Penal Code, pending in the Court of learned J.M., Ranchi is pressed into motion.

Heard the parties.

The gist of the prosecution case is that from 01.11.2017 to 24.11.2017 the rooms of the Hotel Bridge View had been taken on rent by Rose Quartz Entertainment of which the petitioner is the proprietor. The outstanding rent amount of Rs.2,83,600/- has not been paid.

It is submitted by the learned counsel for the petitioner that the present case has been lodged after delay of three years. As a matter of fact, there was an agreement between the owner of the hotel and this petitioner in which the owner of the hotel was the co-producer of a film. It is also submitted that they have already made payment of Rs.1,00,000/- to the Hotel Bridge View by SBI Credit Card, the necessary transactions of payment have been annexed as Annexure-3.

The learned APP opposed the prayer for anticipatory bail. Considering the submissions of the learned counsels and the facts as discussed above, the anticipatory bail application is allowed. Hence, in the event of her arrest or surrender within a period of four weeks from the date of this order, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, subject to the conditions laid down under section 438 (2) Cr. P.C. The petitioner will cooperate in the investigation and will appear on notice under Section 41A of Cr.P.C and comply with the condition as laid down under Section 438(2) of the Cr.P.C.
