1. We have Heard learned counsel appearing for the parties.

By this Special Appeal, the mother of the child studying in Government Upper Primary School, Kamla Nehru Nagar ('K.N.School') has prayed for setting aside the judgment of learned Single Judge dated 18th February, 2015, by which he had dismissed the writ petition challenging the action of the respondent-State in merging the Government Upper Primary, School, Kamla Nehru Nagar ('K.N.School'), Government Upper Primary School, Nayaon Ki Bagechi ('NKB School') and Government Primary School, Rajeev Hattha ('Rajeev Hattha School') with Government Higher Secondary School, Siwanchi Gate, Kamla Nehru Nagar, Jodhpur ('Adarsh School'), based on a clarification of the policy of the State Government to merge the primary 2 schools with the upper primary schools in the State of Rajasthan. A clarification was made by the State Government by an order dated 19.9.2014, on the resentment of the students and teachers all over the State. Learned Single Judge found that the schools were merged and shifted at a distance of 200 meters, which will not cause any inconvenience to the children and that the orders were passed for the efficient management and teaching in the interest of the students.
3. The premises which were vacated by three schools running in the same premises, were utilized by the Education Department for shifting of a College. The College has since been shifted to the premises earlier occupied by three schools and in respect of which a writ petition was dismissed by learned Single Judge, against which, the Special Appeal has been dismissed by us today.
4. Now after a College has been shifted in the premises earlier occupied by three schools, in our view, the Special Appeal has become infructuous on the dismissal of the Special Appeal filed by the students of the College.
5. This Special Appeal is accordingly dismissed as infructuous.
