Petitioner-Surinder Singh @ Surinder Kumar @ Veeru Maan has filed this petition under Section 482 Cr.P.C for quashing the order dated 10.04.2018 passed by the trial Court declaring the petitioner as proclaimed offender in FIR No.25 dated 29.03.2017 registered under Sections 307, 341 and 148 read with Section 149 of Indian Penal Code at Police Station Noor Mahal, District Jalandhar Rural.
On 23.05.2019, following order was passed by this Court:-
"Learned counsel for the petitioner refers to the order dated 05.03.2018 and contends that the notices/non-bailable warrants issued for service of petitioner remained unserved, as the petitioner was abroad. According to him, despite noticing this fact, the trial Court proceeded to declare him as proclaimed offender vide order dated 10.04.2018.
1 of 2 ::: Downloaded on - 08-09-2019 03:03:36 ::: CRM-M-23804-2019 -2- It is pointed out that the petitioner returned back on 03.03.2019 and is willing to participate in the proceedings. It is also pointed out that the perusal of the FIR does not make out a case for the offence under Section 307 IPC and rest of the offences are bailable in nature.
Notice of motion for 20.08.2019.
Let the petitioner appear before the trial Court on 03.06.2019 and on his doing so, the trial Court shall admit him on interim regular bail subject to his furnishing requisite bail bonds and surety bonds."
In compliance of the above order dated 23.05.2019, the petitioner submitted himself before the trial Court on 03.06.2019, whereupon the trial Court granted him interim regular bail on his furnishing bail bonds and surety bonds in the sum of Rs.50,000/-.
As the petitioner has already submitted himself before the trial Court and has been granted interim regular bail, therefore, nothing survives for adjudication in the present petition.
In view of the above, the petition is disposed off and the petitioner is allowed to remain on regular bail and on the same bail bonds and surety bonds furnished before trial Court on 03.06.2019.
