                   WRIT PETITION No.41654 of 2022

ORDER:

Heard learned counsel for the petitioner and Sri Ch.Jagannatha, learned standing counsel appearing for respondent Nos.1, 2 and 4; learned Government Pleader for Services-I appearing for respondent No.3. With the consent of all the parties, the writ petition is being taken up for disposal at the admission stage itself.

This writ petition has been filed seeking a writ of mandamus to declare the respondent university in not extending the remuneration on par with regularly appointed Assistant Professor/Associated professors in terms of Para 13.1 of UGC Regulations on Minimum Qualifications for appointment of Teachers and other Academic Staff in Universities and Colleges and Measures for the Maintenance of Standards in Higher Education 2010 and also the decisions of the Supreme Court in State of Karnataka V/s Umadevi ((2006) 4 SCC 1) as recently affirmed in State of Punjab v/s Jagjit Singh ((2017 1 SCC 148 and Ram Naresh Rawat V/s AswiniRay and others reported in 2017 3 SCC 436 from the date of their initial engagement.

3. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondent authorities to consider the petitioner's representation, dated 16.08.2022.

Learned Standing Counsel appearing for respondent Nos.1, 2 and 4; learned Government Pleader for Services-I appearing for respondent No.3 submits that if the said representation is still pending for consideration, the respondent authorities may be directed to consider the said representation and pass appropriate orders in accordance with law.

In view of the submission made by the both the learned counsels on either side, this writ petition is disposed of directing respondent authorities to dispose the petitioner's representation, dated 16.08.2022 and pass appropriate orders strictly in accordance with law, as expeditiously as possible, preferably within a period of four (04) weeks from the date of receipt of the order, after giving a fair opportunity of hearing to the petitioner and communicate the same to the petitioner.

6. Accordingly this writ petition is disposed of. Miscellaneous applications, if any pending, shall stand closed. No order as to costs.
