ORDER:-
This Writ Petition for a mandamus is filed declaring the action on the part of the respondent - police officials in not completing the investigation and filing the final report in Crime No.85 of 2016 of Narsapuram Rural Police Station as illegal and consequently sought direction to respondents 1 to 3 to complete the investigation in the said crime and to file final report in the concerned Court.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for respondents 1 to 3.
Learend Assistant Government Pleader for Home placed on record the written instructions received by him from the Station House Officer of Narsapuram Rural Police Station wherein it is stated that the entire investigation in Crime No.85 of 2016 which was registered for the offences punishable under Section 324 r/w 34 IPC was completed and the case was referred as mistake of fact after obtaining permission from the SDPO, Narsapuram, as per proceedings, dated 30.04.2017, after serving notice on the petitioner to that effect and that a final report was also filed to that effect in the Court of Additional Judicial Magistrate of First Class, Narsapuram, in S.R.No.5462 on 20.06.2022.
Therefore, as it is stated that the entire investigation is completed long back and that the case was referred as mistake of 2 fact and that the final report was also filed to that effect in the Court of Additional Judicial Magistrate of First Class, Narsapuram, it cannot be said that there are any laches on the part of the Investigating Officer in completing the investigation and in filing final report in the above crime.
Resultantly, the Writ Petition is dismissed. Miscellaneous petitions, if any pending, in the Writ Petition, shall stand closed.
