Heard Sri Rahul Dubey holding brief of Sri Amrish Tiwari, learned counsel for the petitioner, Sri Abhishek Shukla, learned Additional Chief Standing Counsel for the State respondents and Sri Rameshwar Prasad Shukla, learned counsel appearing for the respondent Gram Sabha.
The present petition has been filed seeking to raise a grievance that the respondent-authorities are trying to disturb the possession of petitioner by constructing a "Chakmarg" over land bearing Araji No. 203 situate in Village- Sabarhad Bireacha, Tehsil- Ghosi, District- Mau, which the petitioner claims to be his own.
Counsel for the State respondents submits that pursuant to the previous order, instructions dated 10.03.2023, have been received from the Tehsildar, Tehsil- Ghosi, District- Mau indicating therein that with regard to the aforestated grievances of the petitioner, a team of revenue officials carried out demarcation exercise on 10.03.2023 and has submitted a report which indicates that the "Chakmarg" in question is in existence since long and is now being repaired, and the land which the petitioner claims to be his own bearing Araji No.203 is not being effected. A spot memo report of the demarcation exercise, carried out on 10.03.2023, is stated to have been appended along with the instructions.
Having regard to the aforestated stand taken by the respondent-authorities, counsel for the petitioner fairly submits that no cause of action survives and that the petitioner does not wish to pursue the matter any further.
The petition stands disposed of accordingly.
