                              ORDER:

Heard Mr. Ch.Venkat Reddy, learned counsel appearing for the petitioner and Sri Aitha Prem Sai, learned counsel on record for respondent. Perused the record.

This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure, 1908, by the petitioner- wife seeking to transfer the H.M.O.P.No.91 of 2025 pending on the file of the learned Senior Civil Judge at Jangaon, to the file of the learned District and Sessions Judge - cum - Family Court Medchal- Malkjgiri District at Kushaiguda.

3. Learned counsel for the petitioner submitted that the petitioner- wife has sought transfer on the ground that Jangaon is at a distance of above 100 Kilometers away and it is difficult for her to travel to defend the H.M.O.P.No.91 of 2025.

Respondent-husband opposed the transfer petition on the ground that there is threat to his life and his paralyzed mother life and in that context referred the F.I.R.No.452 of 2025, dated 30.08.2025 which is registered on account of the petitioner and her family members making an attempt to forcibly enter into the residence of respondent where his paralyzed mother is also living. 4.1. Further, learned counsel for respondent submits that the petitioner has studied M. Pharmacy in Hyderabad and she is capable to travel without any companion and he offered to meet the expenses of travel and board, whenever the petitioner attended the Court in Jangaon to defend the H.M.O.P. He further submits that respondent has to take care of his paralyzed mother and therefore, it would be difficult for him to travel frequently to Family Court at Medchal- Malkajgiri District. More so, the petitioner is not required to attend the proceedings on every date of hearing in a H.M.O.P which is a civil RY,J TRCMP_398_2025 3 proceeding. The petitioner may engage a counsel and appear only when her evidence is to be recorded.

In the circumstances of the present case, since the respondent has to take care of his ailing mother, it would be difficult for him to travel to Medchal-Malkajgiri District and since he is willing to pay the travel expenses of his wife, this Court is not inclined to grant relief sought for by the petitioner-wife.

6. In the result, the Transfer Civil Miscellaneous Petition is dismissed. However, respondent-husband is directed to pay travel expenses to the petitioner whenever she travels to Jangaon District to attend the proceedings in H.M.O.P.No.91 of 2025 on the file of the learned Senior Civil Judge at Jangaon. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this petition, shall stand closed.
