----

CORAM : K.R. SHRIRAM & AMIT B. BORKAR, JJ DATED : 15th NOVEMBER 2021 P.C. :

1 Since the final assessment order dated 2nd June 2021 has been passed, which is impugned in this petition, when the proceedings before Dispute Resolution Panel (DRP) is still pending, Mr. Walve in fairness and on instructions states that the final assessment order, which is impugned in this petition, could not have been passed in law. Mr. Walve states that the said assessment order dated 2nd June 2021 and the notice of demand dated 2nd June 2021 both be set aside and the revenue be permitted to take such steps as advised after the DRP disposes the objections filed by petitioner. Mr. Walve states his instructions are also to express regret for the inconvenience caused to this court as well as to petitioner. Accepted. Order accordingly. 2 Petition disposed.
