1. In terms of the previous order granting time to the Delhi Jal Board (DJB) to file the affidavit of competent officer disclosing the timeline for providing sewage coverage to all the JJ Clusters and trapping the sewer lines and diverting them to the proper STPs, affidavit of Chief Engineer (SDW) DJB dated 29.04.2025 has been filed. In paragraph 4 of the said affidavit, it is stated that out of 639 total JJ Clusters, drains of 574 JJ Clusters have already been trapped in nearby DJB sewerage network.
2. Learned Senior Counsel appearing for DJB submits that in respect of remaining 65 JJ Clusters, details are contained in annexure-C which is as under:-

413. In respect of details disclosed at serial nos.5, 6, 7, 8, 9, 10, 11, 13, 14, 15, submission of Senior Counsel for the DJB is that sewage drains of above JJ Clusters will be diverted to Barapullah drain and taken to Okhla STP. It is not in dispute that Barapullah drain is a storm water drain. The Tribunal in the matter of Nizamuddin West Association v Union of India & Ors.; IA No. 537/2023 in OA No. 06/20212 had directed that untreated sewage cannot be discharged in storm water drain. Hence, we find action which has been proposed in respect of the JJ Clusters noted above is contrary to the order of the Tribunal. We require the CEO, DJB, to appear virtually and explain the reasons on the next date of hearing for taking a decision to divert untreated sewage to the storm water drain which runs contrary to the order of the Tribunal.
