O R D E R
Per : Dr.Bhagwan Sahai, Member (A). Since these 7 OAs are identical as the relief sought is mainly against the conduct of performance evaluation test of the applicants by the respondents, these OAs are decided by a common order.
2(a). O.A.359/2020
The applicants have prayed for the following reliefs:
"(a). That the Hon'ble Presiding Officers of this Tribunal be pleased to quash and set aside the advertisement dated 10th/11th October 2020 annexed hereinabove as Annexure A-7; and/or
(b). That the Hon'ble Presiding Officers of this Tribunal be pleased to quash and set aside the notice dated 1st December 2020 annexed hereinabove as Annexure A-11; and
(c). That Hon'ble Presiding Officers be pleased to direct the Respondents to:
i) continue the Applicants on their respective posts/vacancies till they are regularized on the posts/vacancies; or
ii) continue the Applicants on their respective post/vacancies till the time the posts/vacancies are filled in permanently by giving preference to the Applicants; or
d) For such other and further 73 OA.359, 361, 362, 363, 364, 443 & 444/2020 orders as are necessary to do complete justice to the Petitioner in the facts and circumstances of this case."
Summarized facts:
(i). As per advertisement dated 28.06.2012 for appointment of Teachers in Primary and Upper Primary Schools in Dadra & Nagar Haveli, the applicants were appointed for 89 days starting from 23.08.2012. Applicant no.11 and applicants no.33 to 70, were appointed for 89 days in October, 2014, and the applicants no.71 to 95 were similarly appointed in November and December, 2015 in pursuance to another advertisement in 2014. Thereafter till the time of filing the O.A., they have been continued.
(ii). The respondents have issued advertisement on 10/11.10.2020 inviting applications for 278 posts of Assistant Teachers in Primary Schools and for 207 posts of Teachers in Upper Primary Schools even when contractual appointment of the applicants is extended upto 14/30.11.2020. Thus the respondents are trying to replace the adhoc appointee applicants with another set of adhoc appointees. In the renewal order of their contractual appointments dated
74 OA.359, 361, 362, 363, 364, 443 & 444/2020 10/11.10.2020, it was mentioned that further renewal of their appointment shall be subject to their performance evaluation. Therefore, the applicants submitted a legal representation on 30.10.2020 requesting to continue them on their respective posts till they are either regularized/made permanent on those posts or till the posts are filled up permanently by giving preference to them, but no reply was received on their representation. Subsequently the respondents also issued a notice on 03.12.2020 asking all the applicants to attend personal hearing on 09.12.2020 before the Respondent No.3 on their representation dated 30.10.2020 about continuation in the service till the posts are filled up on permanent basis. The applicants apprehend their termination in the guise of performance evaluation. The new applicants are not required to undergo such performance evaluation.
(iii). On 01.12.2020, the respondents issued a notice whereby 587 existing Primary Teachers and Upper Primary Teachers of Gujarati and Marathi 75 OA.359, 361, 362, 363, 364, 443 & 444/2020 medium Schools have been asked to undergo Performance Evaluation Test (PET) on 07.12.2020, consisting of written test followed by personal interview/classroom demonstration. Therefore, this O.A. has been filed against the advertisement of 11.10.2020 and notification of 01.12.2020.
Applicants' contentions in O.A.359/2020
(i). The applicants claim that they are duly qualified and eligible for appointment as Assistant Teachers and Teachers, have cleared the eligibility test for their appointment and after their appointment on short-term contract, they have been continued with annual increments by the respondents for last 15-20 years as teaching in their Schools is not a seasonal or project work but continuous work. Although there are available a number of permanent posts of Assistant Teachers/Teachers, they have been treated as seasonal or project-based under Sarva Shiksha Abhiyan/Samagra Shiksha.

(ii). Out of surplus 831 short term contract teachers, the applicants have been asked to take the PET in a discriminatory manner without specifying the criteria for their selection for the test. So only 75 of applicants in this O.A. have taken it.
(iii). The applicants were selected for short term contract for teaching in Gujarati and Marathi medium. So they cannot be asked to teach in English medium.
(iv). They have no objection to the additional option given in the PET to take it in English Medium.
(v). There are other Gujarati and Marathi teachers who have been excluded from the PET and some have been exempted also.
(vi). Claim of respondents about requirement of English medium school teachers is not correct.

(vii). Due to continued engagement of the applicants on short term contract for a long time, they should not be replaced and be continue as such without the PET.
2(b). O.A.361/2020
The applicants have prayed for the following reliefs:
"a. This Hon'ble Tribunal may graciously be pleased to call for the records of the case from the Respondents and after examining the same be pleased to quash and set aside the impugned Notification dated 01.12.2020 with all consequential benefits.
b. This Hon'ble Tribunal may further be pleased to hold and declare that the action of the Respondents of conducting Evaluation of Performance Test is unconstitutional and illegal and arbitrary.
c. Costs of the application be
provided for.
d. Any other and further order as
this Hon'ble Tribunal deems fit in the nature and circumstances of the case be passed."
Summarized facts:
(i). The applicants in this O.A. were initially engaged as Assistant Teachers 78 OA.359, 361, 362, 363, 364, 443 & 444/2020 (English) on 20.09.2006 on daily wages/contract basis and their services were extended upto 14/30.11.2020. The applicants and others (345) were appointed as Assistant Teachers on daily wages/contractual basis through due process of law as per Recruitment Rules in pursuance to advertisement issued on 08.08.2006. Thereafter 160 posts were also filled up by order dated 11.12.2008. The respondents have continued the applicants as Assistant Teachers working under Sarva Shiksha Abhiyan (SSA) while the services of many others contract teachers have been regularized by order dated 16.12.2008 and subsequent orders.
(ii). As per notification dated 10/11.10.2020, applications from fresh
candidates have been invited for appointment of Assistant Teachers on short-term contractual basis, though there are no vacancies to fill up those posts on contract basis as the applicants are already working on contract basis.
(iii). As per the settled law, one adhoc employee cannot be replaced by another adhoc 79 OA.359, 361, 362, 363, 364, 443 & 444/2020 employee. But to get rid of the applicants, a notification has been issued on 01.12.2020 to evaluate the performance of the short-term contract teachers through PET on 07.12.2020. Aggrieved by this notification, the applicants submitted representation but it was not attended to by the respondents. Therefore, almost 90 applicants have filed this O.A. opposing the PET (actual number of applicants is 88).
Applicants' contentions in O.A.361/2020
(i). The impugned action of the respondents to conduct PET as per notification dated 01.12.2020 is illegal, arbitrary and void ab- initio because at the time of their initial appointment, the applicants had already undergone the selection process consisting of written test and interview, thereby fulfilling the norms of Article 14 of the Constitution, and accordingly they were appointed on contract basis which has been extended from time to time after 2006 without any PET. Now after 10-15 years of their service on contract, conducting 80 OA.359, 361, 362, 363, 364, 443 & 444/2020 of PET is illegal and arbitrary.
(ii). The respondents' action is in violation of Supreme Court decision in case of Hargurpratap Singh Vs. State of Punjab & Ors declaring that replacing one adhoc appointee by another adhoc arrangement is not permissible and that the appointees therein should be continued till the regular appointments are made. In another Supreme Court judgment it has been held that if an incumbent has been selected after undergoing a selection process and worked for more than a decade, then he cannot be subjected to another performance test.
In Writ Petition No.6681/2018, Bombay High Court Ms.K.J. Dabhi & Ors. Vs. Union of India & Anr. decided on 22.04.2019, (page 241 of the O.A.) it has been held that one set of contractual employees should not be replaced by another set of contractual employees, they can be replaced by only candidates selected through regular selection process. An SLP filed against it has been dismissed by the Supreme Court on 81 OA.359, 361, 362, 363, 364, 443 & 444/2020 22.08.2019. As held by Tripura High Court in its order of 23.02.2021 (in case of Shri Sajal Deb Vs. State of Tripura), para 53, the applicants should not be removed, they should be paid remuneration on par with regular Government teachers be regularized on vacant or new posts.
(iii). The applicants are not seeking regularization of their services in this O.A., for that purpose, another O.A. is pending before the Tribunal. The stand of the applicants in their reply about surplus Gujarati medium teachers is not correct. The relief sought in the O.A. is only against the conduct of PET by the respondents. The last order of renewal of their contractual appointment was issued on 11.10.2020 in which it has been specifically mentioned that further extension of contractual appointment will be based on PET, but this contention has not been mentioned in all the orders of continuation of the applicants. If the respondents have surplus contractual teachers, then they should adopt the principle 82 OA.359, 361, 362, 363, 364, 443 & 444/2020 of last come first go.
(iv). The hidden agenda/hidden motive of the respondents to terminate the applicants by conducting PET is crystal clear, particularly in view of their notification dated 11.10.2020 calling for fresh contractual appointments without any PET for the same posts on which the applicants are working, there is no rule or law enabling the respondents to conduct the PET for continuation of contractual service. The action of the respondents is in violation of Article 14 and 16 of the Constitution.
(v). The respondents have discriminated against the applicants as only 587 teachers (out of 832 teachers) have been directed to appear for the PET. The teachers of English, Science and Mathematics have not been directed to take the PET, and only Gujarati and Marathi medium teachers are subjected to it. While the respondents have not regularized the services of the applicants, services of more than 100 other 83 OA.359, 361, 362, 363, 364, 443 & 444/2020 teachers from the same set of teachers have been regularized in 2006 and 2010 without conducting the PET. Therefore, subjecting only the applicants to PET for continuation of service on short-term contract is discriminatory. Therefore, on this ground O.A. deserves to be allowed.
(vi). The ill motive of the respondents in conducting the PET is to give a break in their service which will create hurdle in their regularization. Therefore, this hidden agenda of the respondents behind conducting the TET should be looked into by this Tribunal. The applicants have been awarded many certificates appreciating their service. Therefore, conducting PET for continuing the applicants on the same posts is nothing but exploitation which will cast stigma on their service.
The performance of the applicants can be evaluated only while they are working in the class rooms and also there is system of APAR and there is no rule or instructions issued by DoP&T 84 OA.359, 361, 362, 363, 364, 443 & 444/2020 for conducting test for evaluating performance for the same post on which an employee is already working on contractual basis. Therefore, this action of the respondents will have cascading adverse effect on the applicants.
(vii). The contractual appointment of the applicants since 2006 has been renewed annually and there was no PET conducted earlier for extending their contractual appointment. In pursuance of their notification dated 01.12.2020, some of the applicants have been taken the PET but others have not, and conducting the PET by the respondents is only an attempt to replace the applicants with other contractual teachers. For selection of fresh candidates as per notification dated 11.10.2020, there is no PET prescribed and they will be only interviewed.
(viii). If there is shortage of English medium teachers, then the applicants are also available. But as an afterthought after issuing the advertisement dated 11.10.2020 for fresh 85 OA.359, 361, 362, 363, 364, 443 & 444/2020 appointments, the PET is being conducted to remove them. The respondents should have conducted the PET first and then issued the advertisement if any posts still remain vacant.
(ix). During hearing of arguments on this O.A.361/2020 on earlier dates, when it was pointed out by the respondents' counsel that 28 applicants in this O.A. have been exempted from the PET, on 16.08.2021 Shri Nagrani undertook to file in next two days on M.A. for amending the O.A. by withdrawing the 28 applicants who have been exempted from the PET, and to file his written arguments. But he did not comply with his undertaking and did not withdrew those 28 applicants. In the written arguments he has taken a funny plea that though they have been exempted from the PET now, they are likely to be affected in future, hence they are challenging the PET.
2(c). O.A.Nos.362, 363, 364, 443 and 444/2020
The applicants have sought the
following reliefs:
86 OA.359, 361, 362, 363, 364, 443 & 444/2020 "(a). This Hon'ble Tribunal may graciously be pleased to call for the records of the case which led to issuance of the impugned Order dated 01.12.2020 i.e. Annexure "A1" and after going through its propriety, legality and constitutional validity be pleased to quash and set aside the same.
(b). This Hon'ble Tribunal may graciously be pleased hold and declare that the impugned action of the Respondents to conduct Written Test or Interview for EVALUATING THE PERFORMANCE of the Teachers (Applicants) already selected after by following due Selection Process is illegal and wrong and hold that the Respondents cannot conduct the same in the manner as stated in Notice dated 01.12.2020.
(c). This Hon'ble Tribunal may be pleased to hold and declare that based on the Written Test and Interview conducted or to be conducted for EVALUATING PERFORMANCE of the Applicants vide Notice dated 01.12.2020 or any other such Notice, the Respondents cannot terminate the services of the Applicants based of the same.
(d). This Hon'ble Tribunal may graciously be pleased to Order and direct the Respondents (e). Any other and further orders
as this Hon'ble Tribunal may deem fit, proper and necessary in the facts and circumstances of the case.
(f). Costs of this Original Application may be provided for."
87 OA.359, 361, 362, 363, 364, 443 & 444/2020 Summarized facts :
Since facts, reliefs sought and grounds raised in all these five OAs are identical, with the consent of applicants' counsel O.A.362/2020 has been taken up as the lead case.
(i). In this O.A. the applicants have stated that they were appointed as Primary Teachers by a due selection process i.e. written test and interview in pursuance to advertisement dated 11.09.2006. By an order dated 13.06.2013, the applicants and similarly placed others were regularized in service but subsequently that order was illegally kept in abeyance which was challenged by the applicants in O.A.742/2013 and O.A.88/2014. Those OAs were heard together and decided by order dated 14.02.2020, directing the respondents to decide the pending representation of the applicants and maintain status-quo about their service till then. Accordingly the applicants have made supplementary representation in February, 2020. Thus in spite of their regularization, the applicants have been continued to work on contract basis.
88 OA.359, 361, 362, 363, 364, 443 & 444/2020
(ii). The respondents have issued a notice on 01.12.2020 asking the applicants to appear in written test and personal interview on 07.12.2020. Therefore, 42 applicants in O.A.742/2013 and 14 in O.A.88/2014 have now filed this O.A. Contentions of applicants in O.A.362, 363, 364, 443 & 444/2020 :
(i). The applicants were appointed as contractual teachers under SSA in Gujarati and Marathi medium schools as per the prescribed selection process. Since then they have continued in service without any break, they were regularized by order of Zilla Panchayat President in 2013 which was subsequently withdrawn by order of 01.07.2018. It was contested in O.A.742/2013 and O.A.88/2014 and as per order of the Tribunal dated 14.02.2020, they submitted a representation in February, 2020 which has been decided by Administrator of Union Territory of Dadra & Nagar Haveli and Daman & 89 OA.359, 361, 362, 363, 364, 443 & 444/2020 Diu on 01.02.2020 rejecting the representation.
That order has been challenged in separate O.A.222/2020 and O.A.No.402/2021.
(ii). Before issuing the notice on 01.12.2000 for the PET, the respondents did not issue show cause notice to them, it has been designed only out of pure ill-will to create a background for their termination and nothing else. This order dated 01.12.2020 has been passed in whimsical, capricious and mischievous manner only to somehow alter the status of the applicants, who were regularized in service on 13.06.2013 but this has been subsequently kept in abeyance.
(iii). Most of the applicants are in their 40 or 50 years of age, they did not receive any memo on shortcoming in their work during last 14 years and, therefore, to ask them to appear in the written test when they had already undergone a regular selection process is absolutely arbitrary, illegal and wrong. The purpose for holding the PET is only to deny the legitimate regularization of their service and to finally 90 OA.359, 361, 362, 363, 364, 443 & 444/2020 terminate them. There is no clarity as to why and for what purpose and how the written test is to be conducted. There is no rule or law on the basis of which this notice was issued. The applicants have also undergone various training programmes from time to time. No such examination by a private organization or Government Department has ever been conducted for assessing the performance of teachers or other employees. Therefore, objective of PET to be conducted for Primary and Upper Primary Teachers is not understood.
(iv). The present case of conducting the PET is serious and illegal discrimination as no such written test is being conducted for regular teachers, contract teachers other than Gujarati and Marathi medium teachers and other regular or contract teachers for T.G.T. or P.G.T. Staff. The evaluation of performance of the teachers cannot be done by PET, it can be done only in class rooms. Some of the applicants have taken TET but others have not. There is no provision in rules for conducting this PET. Before 91 OA.359, 361, 362, 363, 364, 443 & 444/2020 conducting PET, the applicants were not given adequate time for preparation. It is done for the first time, only for Gujarati and Marathi medium contractual teachers. The applicants have no objection to the option provided by the respondents for other than English medium teachers to participate in English medium test.
(v). In the reply submitted by the respondents, neither reasons for conducting for PET nor the authority who has taken this decision have been mentioned. Therefore, conducting of this test is illegal. The minutes of the meeting held in the Ministry of Human Resource Development, Government of India did not mention for conducting of PET. No reply has been filed by the Department of Education, Ministry of Human Resource Development, Government of India, although respondent no.1 in this O.A.
(vi). Conducting PET by the respondents is unilateral, bad, arbitrary and unauthorized, without jurisdiction and in violation of 92 OA.359, 361, 362, 363, 364, 443 & 444/2020 Articles 14 and 16 of the Constitution. This test is being conducted after the decision of the Tribunal in O.A.742/2013 and O.A.88/2014 and it is a classic case of highhandedness and abuse of powers and nothing else. Thus subjecting the applicants to PET and the another selection process is illegal.
(vii). The argument of the respondents about appointment of the applicants under the SSA project and not on regular basis is just to create confusion. The applicants rely upon the Tripura High Court decision (Para 8), Supreme Court decision in case of Nihal Singh Vs. State of Punjab, reported in (2013) 14 SCC 65 and Supreme Court decision in State of Karnataka Vs. Umadevi, reported in (3) 2006 4 SCC 1. The applicants deserve to be treated with dignity and on par with the regular teachers without any test of their performance.
(viii). The reason given by the respondents for the PET to select the teachers for English medium schools is not correct. Syllabus for the 93 OA.359, 361, 362, 363, 364, 443 & 444/2020 PET test has not been given in Marathi and Gujarati languages. More than one opportunity has not been given to the applicants for the PET. The respondents just want to terminate them. Therefore, these OAs should be allowed.
3. Contentions of the respondents The main issue contested in all these seven OAs is conducting of the Performance Evaluation Test (PET) for the applicants. The respondents have filed a common reply and additional reply in all these 7 OAs. A gist of their contentions is as follows:
(a). There has been increase in demand for school education in English medium during last decade and, therefore, enrolment in English medium schools has increased drastically with corresponding decrease in enrolment in Gujarati and Marathi medium schools of the Union Territory. Enrolment in the English medium schools in the year 2010-2011 was 8279 and during the year 2019-2020 it was 20532, whereas 94 OA.359, 361, 362, 363, 364, 443 & 444/2020 in Gujarati and Marathi medium schools it has come down from 43294 and 9724 in the year 2010-
2011 to 2087 and 6203 in 2019-2020, respectively. Because of this, 16 primary/upper primary schools have been started/upgraded to English medium schools and now there are 26 Government English medium primary/upper primary schools (classes I to VII) in the UT.
There are 1680 sanctioned posts of the Primary and Upper Primary School teachers whereas the requirement is 2101. To teach in these English medium schools, 602 teachers are required but only 209 teachers are available, thus there is deficit of 393 teachers. Additionally there is deficit of subject teachers of Maths, Science and English language in other than English medium upper primary schools.
(b). As per Right to Education Act, 2009 norms, 395 Gujarati medium teachers are surplus in the primary schools and 33 surplus Marathi medium teachers in primary and upper primary 95 OA.359, 361, 362, 363, 364, 443 & 444/2020 schools but there is a deficit of 278 teachers in primary section in English medium schools. There is also deficit of 28 teachers in the upper primary schools for teaching English language as a subject. Because of this deficit of teachers in English medium schools, quality of teaching has been seriously affected as those schools are being run by surplus of Gujarati and Marathi medium teachers.
To avoid further deterioration in quality of school education, rationalization of teachers is necessary by providing subject and medium specific teachers to each school. About 80% of students in Primary and Upper Primary Schools in Union Territory belong to Tribal communities and, therefore, it is prime responsibility of the respondents to improve the quality of their teaching.
(c). This subject of surplus and deficit teachers has been discussed in meeting of Project Approval Board of Samagra Shiksha for the year 2020-21 chaired by Secretary 96 OA.359, 361, 362, 363, 364, 443 & 444/2020 (Education), Ministry of Human Resource Development, Government of India and it has been directed that 23.3% Primary Schools and 25.5% Upper Primary Schools are with adverse PTR in the UT of Daman & Diu and, therefore, the required number of teachers has to be posted at elementary level.
(d). All the applicants in these OAs have been engaged on short term contract under Sarva Shiksha Abhiyan/Samagra Shiksha. Since SSA/SS is a centrally sponsored scheme (100% funded) of Ministry of Human Resource Development, Government of India, as per their directions, rationalization of teachers is necessary.
Therefore, it has been decided by the UT administration that as the first step for rationalization of surplus contractual teachers, they should be put through Performance Evaluation Test (PET) consisting of a written test followed by interview/classroom demonstration, and the teachers called for this test would be provided sufficient opportunity to 97 OA.359, 361, 362, 363, 364, 443 & 444/2020 be assessed for the posts for which they were engaged. In addition they would also be provided an opportunity to be evaluated for the English medium posts on which they have been teaching for the past few years, e.g. if a Gujarati Medium Primary School Teacher has been teaching in English Medium Primary School, he/she can also appear for PET for evaluation in English medium in addition to Gujarati Medium.
The second step in teacher rationalization is fresh recruitment for which an advertisement was issued on 10.10.2020 but the respondents intend to accommodate the maximum possible existing surplus teachers against those advertised vacancies also. For this reason the recruitment procedure held on 12.11.2020 for fresh recruitment has been kept on hold till performance evaluation of existing surplus contractual teachers gets completed.
(e). For rationalization of the surplus contractual teachers, the respondents have taken a reasonable view and maximum care has been 98 OA.359, 361, 362, 363, 364, 443 & 444/2020 taken to accommodate them, including the applicants in these OAs, by providing them opportunity to appear for PET in English medium also in addition to the Gujarati and Marathi medium in which they have been teaching.
(f). Since the applicants and other contractual teachers have been appointed under the Centrally Sponsored SSA/SS, their continuation is subject to renewal from time to time and, therefore, they have not been engaged on sanctioned regular posts. When the applicants and other contractual teachers were engaged initially, terms of their engagement were clearly specified in advertisements issued from time to time which were unconditionally accepted by them. Thus the SSA/SS, Union Territory Mission Authority reserves the right to terminate their services at any time and they have no right to claim regular appointment for those posts in future.
In these OAs the applicants have not challenged those terms and conditions of their 99 OA.359, 361, 362, 363, 364, 443 & 444/2020 engagement from time to time on short term contract. In fact the last order dated 11.10.2020, renewing their contract also specifically mentioned that any further renewal of their contractual engagement would be subject to their performance evaluation. It is necessary to continuously monitor and evaluate performance of teachers under the SSA/SS, such evaluation has been done in the past also.
(g). Because of requirement of teachers in excess of the sanctioned posts, the applicants have been engaged and continued on contractual basis. For the contractual posts under the SSA/SS, there is no reservation roster, therefore, no reserved category posts have been indicated. On the basis of their performance evaluation, all the surplus contractual Gujarati and Marathi medium school teachers are not going to be discontinued and the required number of teachers even in Gujarati and Marathi medium schools will be continued.
(h). Earlier OAs (408/2018, 409/2018 and 100 OA.359, 361, 362, 363, 364, 443 & 444/2020 478/2018) having identical matters were dismissed vide order of this Tribunal dated 05.09.2018 holding that there is a purpose set out by the respondents to improve quality of primary education and they are adopting objective standards that can apply across the candidates for their selection to replace many of the Gujarati medium schools with English medium schools, therefore, that action of the respondents was with a public interest objective and not arbitrary and grant of age relaxation to serving STC/SSA employees was also provided. In the advertisement issued on 11.10.2020, age relaxation for SC/ST/OBC and PH candidates has also been stipulated for the candidates already working with the UT Administration as per the relevant rules and OMs of the Government of India.
(i). As per order dated 06.12.2020 of the Tribunal in these OAs, the respondents postponed conducting of PET to 23.12.2020 and accordingly it has been conducted on that date. In the order dated 22.12.2020, the Tribunal rejected 101 OA.359, 361, 362, 363, 364, 443 & 444/2020 the request of the applicants in these OAs for staying conducting of PET and the respondents were asked to go ahead with it and the applicants were also directed to participate in it. Thereafter 2/3rd of the applicants in these five OAs have taken the PET on 23.12.2020, as detailed below:

Since 2/3rd of the applicants in these OAs have already taken the PET, on this ground these OAs should be dismissed with cost. The order of the Tribunal rejecting to stay holding of the PET dated 22.12.2020 was challenged in 102 OA.359, 361, 362, 363, 364, 443 & 444/2020 the Bombay High Court in Writ Petitions No.745/2020 & 746/2020 which on considering the order of the Tribunal were disposed of as per High Court order dated 14.01.2021 concluding that it was not necessary to deal with contentions of the petitioners in those WPs.
In view of these facts, there is no merit in these OAs and they should be dismissed with cost.
4. Analysis and conclusions :
(a). We have carefully considered submissions of the parties in these 7 OAs. The main contention raised by the applicants in these OAs is against holding of their Performance Evaluation Test (PET) by the respondents for their redeployment in English medium schools. In O.A.359/2020, additionally the applicants have also sought setting aside of advertisement dated 10/11.10.2020 for inviting applications for 278 posts of Assistant Teachers in Primary School and 207 posts of Teachers in 103 OA.359, 361, 362, 363, 364, 443 & 444/2020 Upper Primary Schools. However, in their reply, the respondents have submitted that in order to first rationalize deployment of the surplus Gujarati and Marathi medicum contract teachers in English medium schools, they have kept the new recruitment on hold. Therefore, we are not dealing with this relief of this O.A.
(b). The stand of the applicants against holding of the PET is not tenable. After initial selection, they have been engaged as Assistant Teachers/Teachers for Gujarati and Marathi medium primary and upper primary schools purely on short term contract under the Sarva Shiksha Abhiyan/Samagra Shiksha which has been renewed from time to time, the last order being of 11.10.2020 stipulating further renewal subject to performance evaluation. Thus their engagement has been only under the Centrally sponsored SSA/SS Scheme/project. They have not been engaged on regular posts of School establishment of the UT administration. As per the terms of their engagement, their short term contract is liable for termination at any time.
104 OA.359, 361, 362, 363, 364, 443 & 444/2020 The SSA/SS Scheme has a definite life span of its own, so their engagement is not against sanctioned permanent posts. Their engagement is also not on adhoc basis against regular posts.
The rhetorical arguments of the applicants' counsels that the applicants are being paid salaries much lower than the regular teachers under the UT Administration (without furnishing any details of payment), they are being exploited as bonded labourers, there is hidden agenda of the respondents in conducting the PET to get rid of them/terminate them, their continued engagement on contract is against basic aim of education, requirement of teaching being permanent in nature, have only wind and no substance. Their engagement being under the SSA/SS Scheme, it is governed by the guidelines and instructions of Government of India for implementing this Scheme. Therefore, the applicants' contention that initially they were selected for short term contract, so thereafter their performance as teachers cannot be evaluated makes no sense. Their further contention that their performance can be 105 OA.359, 361, 362, 363, 364, 443 & 444/2020 evaluated only in class room is also irrelevant as interview/classroom demonstration is already a part of the PET design.
(c). As explained by the respondents, they were never employed on regular posts, the caselaws relied upon by them relate only to adhoc appointments on regular establishments and not for those engaged on short-term contract under the Sarva Shiksha Abhiyan/Samagra Shiksha.
(d). There is no hidden agenda behind the PET. As the applicants are themselves aware, because of the increasing enrolment of students in English medium schools over the last decade and corresponding decline in enrolment of students in Gujarati and Marathi medium schools, the applicants engaged on short-term contract in the Marathi and Gujarati medium schools have become surplus in view of the Pupil Teachers Ratio (PTR) requirement and there is deficit of 393 English medium teachers. Therefore, the intention of the respondents is bonafide to conduct the performance evaluation test of the 106 OA.359, 361, 362, 363, 364, 443 & 444/2020 surplus Gujarati and Marathi medium school teachers for their rationalization and redeployment in those English medium schools. About the changing pattern of student enrolment, the applicants cannot feign ignorance. Since a teacher is always a learner himself, they ought to have anticipated becoming surplus and learnt to teach in English medium also which only some of them seem to have done, thereby getting exempted from the PET. The PET is not very tough and it consists of only a written test followed by interview or classroom demonstration on the subjects that the applicants have been teaching in the Gujarati and Marathi medium schools.
(e). Since some of the applicants also have experience of having taught a few subjects in English medium schools, although they are engaged in Marathi and Gujarati medium schools, in the PET they have also been given the option of taking the test in English medium as there is deficit of 393 teachers in the English medium schools.
107 OA.359, 361, 362, 363, 364, 443 & 444/2020
(f). The PET is to provide an opportunity to these Gujarati medium teachers i.e. applicants to qualify for teaching in English medium schools. The arguments of the applicants that all Gujarati and Marathi medium schools teachers should be subjected to PET is not correct because only those Gujarati and Marathi medium school teachers who have become surplus have been asked to take the Performance Evaluation Test and based on their performance in this test, they are to be redeployed in the English medium schools. No legal right of the short- term contractual teachers has been violated by the respondents.
(g). While rejecting the request of the applicants for stay to the PET, as per order dated 20.12.2020 the Tribunal had directed the respondents to go ahead with it and the applicants were directed to participate in it. However, out of the applicants in OA.No.359, 361, 362, 363, 364/2020, only 2/3 rd of the applicants have participated in the PET and 1/3rd 108 OA.359, 361, 362, 363, 364, 443 & 444/2020 have not. Out of those who have not participated, 36 applicants were also exempted from appearing in the test because of their earlier experience of teaching some subjects in English medium schools. Thus apart from who have participated in the PET and exempted from it, rest of the applicants have defied the order of the Tribunal for which they deserve to be punished.
(h). After submission of reply and additional reply of the respondents and during arguments of the counsel, when the respondents pointed out these details of participation and non-participation in the PET, while other counsels did not make any submission on this issue, Shri Nagrani in O.A.361/2020 first sought time to seek instructions of 28 applicants in O.A.361/2020, (who were exempted from the test) about their deletion from the O.A., and subsequently he submitted that he would withdraw those applicants by submitting an affidavit/MA for this purpose. However, Shri Nagrani counsel did not submit any affidavit or M.A. for 109 OA.359, 361, 362, 363, 364, 443 & 444/2020 withdrawal of those 28 applicants from the O.A. Out of the applicants in the five OAs (359, 361, 362, 363 & 364/2020), since 36 have been exempted from the PET and 2/3rd of the applicants in those 5 OAs have already participated in the PET, now they cannot challenge conducting of the test and, therefore, those applicants ought to have been deleted from these OAs.
(i). As per the documents on framework for implementation of SSA and SS made available to us by the respondents, a gist of stipulations pertaining to teachers is as follows:
The centrally sponsored scheme SSA was started from 2000-2001 for universal elementary education in the country. Subsequently Rashtriya Madhyamik Shiksha Abhiyan was also started in 2009 for Secondary School Education. Then there was another scheme of teachers education. Subsequently since 2018 all these three Schemes have been merged into Samagra Shiksha i.e. integrated scheme for school education with pre- school, primary, upper primary, secondary and
110 OA.359, 361, 362, 363, 364, 443 & 444/2020 higher secondary levels, as per requirement under Right to Education Act, 2009 and sustainable development goals for education as agreed by the member Countries of the United Nations. The SSA/SS for UT Administration is 100% funded by the Government of India but this assistance is not available under the scheme for filling up State/UT Government vacancies of teachers. There is provision for performance indicators for teachers (PINDICS), for their recruitment, evaluation, monitoring and supervision of performance and learning output of teachers (item 7.14 REMS of SSA framework and item 5.8 of SS framework). The recruitment of teachers is to be on annual basis as per PTR (Pupil Teacher Ratio) norms in the schools. There is also provision of deployment and redeployment of teachers to meet the PTR norms. From these stipulations in the guidelines of the SSA / SS, the PET has been designed for the surplus short-term contract Gujarati and Marathi medium teachers for their redeployment in English medium schools, where there is deficit of teachers and quality of teaching is 111 OA.359, 361, 362, 363, 364, 443 & 444/2020 suffering. Therefore, we do not find anything unreasonable or unfair in this, particularly when the test is to assess their performance both in the written test and interview/class room demonstration on the same subjects which the applicants have been teaching. Thus the applicants have been provided fair, reasonable and equal opportunity in the test including additional option to take the test in English medium as well. Those of the applicants who have some experience of teaching in English medium have been exempted too.
(j). The caselaws relied upon by the applicants pertaining to not allowing replacement of one set of contractual or adhoc appointees by another set of adhoc or contractual employees are not relevant to this scheme and the PET. It is not the intention of the respondents to replace one set of applicants i.e. short-term contract teachers through this PET by other short-term contract teachers. This test has been conducted for selecting those out of the surplus Marathi and Gujarati medium 112 OA.359, 361, 362, 363, 364, 443 & 444/2020 contractual school teachers who are fit to teach in the English medium schools for their redeployment to meet the PTR in those schools.
Reliance of the applicants on Tripura High Court decision is also not directly relevant to the present case of the PET. The main issue in that decision pertained to regularization of contractual teachers and parity in service conditions of the contractual teachers vis-a-vis permanently employed school teachers. In that case the respondents (State Government of Tripura) had expressly submitted that it was in the process of regularizing the contractual teachers and to bring their service conditions on par with regular teachers. However, there was no issue agitated in that case about conducting of performance evaluation test for redeployment of surplus teachers. Here in the instant case the test has been conducted for the surplus Marathi and Gujarati medium school teachers for their redeployment with the English medium schools where there is deficit of teachers.

(k). In view of the above analysis of facts and merits of the case, we find that the action of the respondents in holding the Performance Evaluation Test is reasonable and fully justified. The contentions of the applicants for not holding the Performance Evaluation Test have no merit, especially since 2/3rd of them involved in the 5 OAs have already participated in the test and 36 others have been exempted. Therefore, the OAs are only a wasteful litigation, and deserve to be dismissed with costs. However, we are restraining from imposing the cost.

O.A.Nos.359, 361, 362, 363, 364, 443
and 444/2020 are dismissed. No costs.
