ORDER
Information sought:
The Appellant filed online RTI Application dated 12.10.2020 seeking information on the following six points:
The CPIO/Asstt. Director (A), ESIC Hospital & ODC (EZ), Joka, Diamond Harbour Road, Kolkata vide letter dated 04.11.2020, informed to the Appellant as under:Page 2 of 5
CIC/ESICO/A/2020/698457 Being dissatisfied, the Appellant filed a First Appeal dated 12.11.2020. The First Appellate Authority vide order dated 25.11.2020, informed as under:
Grounds for Second Appeal:
The Appellant filed a Second Appeal u/s 19 of the Act on the ground of unsatisfactory reply furnished by the Respondent. Appellant requested the Commission to direct the CPIO to provide complete information sought for.
Submissions made by Appellant and Respondent during Hearing: The Appellant did not participate in the hearing despite being served the hearing notice.
The Respondent submitted that the information sought by the Appellant is voluminous in nature containing 4-5 files, dissemination of which will attract the provisions of Section 7 (9) of the RTI Act and that is why they have offered an opportunity of inspection to the Appellant but to no avail.Page 3 of 5
CIC/ESICO/A/2020/698457 Decision:
Upon perusal of the facts on record as well as on the basis of the proceedings during the hearing, the Commission observes that though an appropriate reply has been provided by the Respondent vide letter dated 04.11.2020 and 25.11.2020, but the Appellant has not availed the opportunity of inspection till date, for the reasons best known to him. The Commission further observes that the information sought by the Appellant is voluminous in nature which would disproportionately divert the resources of the public authority. Moreover, the Appellant did not participate in the hearing to buttress his case, the Commission is unable to provide any relief to the Appellant. Hence, no further action lies. With the above observations, the instant Second Appeal is disposed of. Copy of the decision be provided free of cost to the parties.
The Appeal, hereby, stands disposed of.
