ORDER
PER URMITA DATTA SEN, MEMBER (J):
This instant application has been filed by the applicants basically challenging the impugned Memorandum dated 17.09.2018, whereby their claims for grant of HRA at the rate of 'B' class city, has been rejected on the alleged ground that the benefit of HRA at the 'B' class city rate are only extended to the applicants of O.A. No. 381/2000 and O.A. No. 267/2017. They are also challenging the impugned Speaking Order dated 11.04.2019 passed by the respondent authority.
2. As per the applicants, on the basis of the Fourth Pay Commission report, Aizawl in the State of Mizoram, was classified as a 'B' class city. Subsequently, pursuant to the Fifth Pay Commission report, Aizawl was reclassified as a 'C' class city vide Notification dated 14.05.1993 and rest of the Mizoram was classified as O.A. No. 231/2019 23 "unclassified" for the purpose of HRA. However, by virtue of Clause-3 of the Office Memorandum dated 03.10.1997 (Annexure-A/3), the Central Government employees posted in Aizawl were kept entitled to receive the HRA at the rate applicable to 'B' class cities until further Orders. Thereafter, consequent upon the implementation of the recommendation of the Sixth Pay Commission, the existing categories of 'C' class cities and 'Unclassified' places have been clubbed together and have been put under a new category classified as 'Z' with HRA @ 10% of pay w.e.f. 01.09.2008 vide Office Memorandum dated 29.08.2008 (Annexure- A/4). Even, paragraph 7 of the said O.M. dated 29.08.2008 provides that - all the other conditions governing grant of HRA under existing order shall continue to apply. Therefore, there is no change as regards to the classification/entitlement of HRA after Sixth Central Pay Commission. In the meantime, the benefits of HRA of 'B' class cities of the Govt. O.A. No. 231/2019 24 employees who are working at Aizawl (Mizoram) were denied.
3. Being aggrieved with, 697 employees, who were working in different departments of the Central Government had approached this Tribunal in O.A. No. 381/2000, which was disposed of vide Order dated 12.04.2002. However, being aggrieved with this Order, the respondents had preferred a Writ Petition before the Hon'ble Gauhati High Court. The Hon'ble Gauhati High Court vide Order dated 25.04.2003 had affirmed the Order of this Tribunal dated 12.04.2002. Being aggrieved with, the respondents preferred a Special Leave Petition before the Hon'ble Apex Court in Civil Appeal No. 646/2005, wherein the Hon'ble Apex Court vide it's order dated 17.07.2013, while dismissing the same held that the Order of this Tribunal did not call for any interference. In the meantime, similarly situated employees of All India Radio and Doordarshan Kendra O.A. No. 231/2019 25 had approached this Tribunal in O.A. No. 146/2019 (Annexure-A/5), which was also disposed of vide Order dated 07.05.2019 by directing the respondents to verify the factual details of those applicants with the applicants of O.A. No. 282/2013 and if the applicants would be found similarly situated, similar benefits of granting of HRA with consequential benefits to be extended to the applicant of that case.
4. Further, another set of similarly situated employees working in the Office of the Accountant General, Mizoram, had approached this Tribunal in O.A. No. 044/267/2017 on the same prayer, which was also disposed of vide Order dated 19.09.2017 (Annexure- A/7) with a direction to the respondents that, if the applicants of that petition would be found similarly situated, similar benefits may be granted to them also. Thereafter, the Office of the Deputy Accountant General (Admn.), after seeking approval from the O.A. No. 231/2019 26 Ministry of Finance, had passed Order dated 19.07.2018 (Annexure-A/8) extending the benefit of HRA at 'B' class cities rates to the said applicants.
5. Sri M. Chanda, Learned Counsel for the applicants has submitted that similarly, Department of Post also had passed an Order dated 01.03.2016 (Annexure-A/9) after extending similar benefits to the employees who were working under the Administrative control and who were applicants in O.A. No. 381/2000. According to Sri Chanda, employees of Nehru Yuva Kendra Sangathan, Aizawl (Mizoram) had also granted the same benefits vide Order dated 08.03.2017 (Annexure-A/10).

Sri Chanda has further submitted that since the present applicants being similarly circumstanced and the benefits of HRA @ 'B' class city rate were not extended to them, they made representations dated 02.07.2018 and 30.06.2018. However, their O.A. No. 231/2019 27 representations were not considered. Being aggrieved with, the applicants initially filed one O.A. No. 395 of 2018, which was disposed of by this Tribunal vide Order dated 27.11.2018 (Annexure-A/16) by directing the respondents to dispose of the representations and communicate their decision to the applicants forthwith. In pursuance to the said direction, the respondents had issued the impugned speaking Order dated 11.04.2019 (Annexure-A2) by holding that the present applicants are not entitled to HRA @ B/Y class city rates.

It has been further submitted by Sri Chanda that since different Department of the Central Government had already extended the benefit of 'B' class city rate to the similarly circumstanced peoples, therefore, the present applicants cannot be denied to get extension of the said benefits only on the ground that they were not part of those applications/O.As, which amounts to clear discrimination between the O.A. No. 231/2019 28 similarly circumstanced peoples and the respondents should extend the said benefit automatically to all the similarly situated employees of Central Government Departments posted at Aizawl. In support of his contention, Sri Chanda has referred the following rulings:-

2. AIR 1987 SC 820 (Abid Hussain & Ors. Vs. Union of India & Ors.).

According to the Learned Counsel for the applicants, the employees working in the Postal Department, Accountant General, Customs and Central Excise Department, Doordarshan Kendra, Census Department, Field Publicity Office, Sports Authority of India, National Informatic Centre, Telecom Department, Telegraph Department, Department of Audio, Video Publicity, Khadi and Village Industries Board, Nehru Yuva Kendra, Central Integrated Paste Management, Sub-Regional Employment Office and O.A. No. 231/2019 29 Press Information Bureau in the State of Mizoram are getting HRA at the 'B' class city rate. However, the present applicants, who are similarly situated and posted in the State of Mizoram under the administrative control of Subsidiary Intelligence Bureau, Mizoram, Aizawl has been denied the similar benefit of HRA which is totally illegal and discriminatory on the part of the respondents. Being aggrieved with, the applicants have filed this instant petition.
11. The respondents have filed their written statement, wherein it has been stated that while implementing the Order passed in O.A. No. 381/2000, which was filed by the Central Government Employees working in various departments, the Government did not allow HRA at 'B'/'Y' city rates to all employees posted at Aizawl, but restricted it to the applicants only.
12. It has been further stated by the respondents that the Department of Expenditure (MoF), while O.A. No. 231/2019 30 allowing HRA @ 'Y' class city to the applicants in O.A. No. 267/2017, advised to implement the Order dated 19.09.2017 passed by this Tribunal with respect to the applicants of the said O.A. only and subsequently, in compliance of the Order dated 27.11.2018 passed in O.A. No. 395/2018, a Speaking Order dated 11.04.2019 was issued by them in consultation with the Ministry of Finance. Therefore, since in each and every matter, benefit was extended to the applicants of the said O.As, therefore, present applicants are not entitled the same.
13. Sri R. Hazarika, Learned Addl. CGSC for the respondents has further submitted that as the Aizawl city was classified under 'C' class city vide O.M. dated 14.05.1993, therefore, employees posted at Aizawl are entitled to get HRA @ 'C' class city only. After implementation of 5th CPC, since the classification of Aizawl remained unchanged, therefore, there is no O.A. No. 231/2019 31 question of putting Aizawl under lower classification and as such, Clause 3 of the said OM is not applicable in respect of Aizawl. Presently, after implementation of 7th CPC, vide O.M. dated 07.07.2017, Aiwawl has been classified as 'Z' class city. Therefore, the applicants who are posted at Aizawl only, are entitled to 'Z' class city rates for the purpose of HRA.
14. The applicants have filed their rejoinder whereby they have denied the contention of the respondents and have reiterated their submissions already made in the O.A. However, they have enclosed one Order dated 01.03.2016 issued by the Department of Posts, Dak Bhawan, Sansad Marg, New Delhi (Annexure-R/1).
15. We have heard Sri M. Chanda, learned counsel for the applicants and Sri R. Hazarika, learned Addl. CGSC for the respondents and perused the records.

It is noted that as per the applicants, different departments of the Central Government had paid the HRA @ 'B' class city rates by extending the benefit of the Judgment and Order dated 12.04.2002 passed in O.A. No. 381/2000 (Annexure-17) as well as Order dated 19.09.2017 passed in O.A. No. 044/267/2017 (Annexure- A/7), which was further affirmed by the Hon'ble Gauhati High Court.

It is further noted that in para (ii) of the impugned Speaking Order dated 11.04.2019 (Annexure- A/2), the respondents have admitted that 697 Central Government employees, working in various departments had approached this Tribunal in O.A. No. 381/2000, wherein different departments were impleaded as respondents and the benefits of 'B' class city rates were extended to those applicants only and since the present applicants were not part of the said O.A., therefore, said benefit is not applicable to them. 18. It is the cardinal principle of law that classification of any city should be one and same for all Central Government employees. It cannot be one class of city for one set of employees and another class of city for another set of employees.
19. It is further noted that as per concurrence of the Ministry of Finance, different department had granted the benefit of Group 'B' city's rate even after implementation of 5th CPC, therefore, Aizawl at Mizoram cannot be termed as Group 'B' city for those employees of different departments, who had approached this Tribunal in O.A. No. 381 of 200o and O.A. No. 267 of 2017 and the same city would not be classified as 'C' class city with regard to other sets of employees.
20. Further as per the respondents, Clause 3 of the Office Memorandum issued by the MoF is not applicable with respect to Aizawl. However, same issue O.A. No. 231/2019 34 was considered by the Hon'ble Gauhati High Court in their Judgment and Order dated 23.12.2009 passed in WP(C) No. 1035/2007 (Annexure-A/14) with regard to the employees of the same respondents of Kohima (which city was also classified as 'C' class city like Aizawl, Mizoram) wherein it has been observed in paras 8, 9, 10 as follows:-
8. The Apex Court in Civil Appeal No. 2705/1991 (Union of India & Ors. Vs. Shri S.K. Ghosh & Ors.) vide order dated 18.02.1993 while considering the claim of Group-C and D employees of Postal & Telecommunication Department posted in the State of Nagaland claiming HRA at the rate as admissible to the employees posted in 'B' class cities, referring to the Presidential order dated 08.01.1962, had held that those employees are entitled to HRA at the rate which had been prescribed by the 4th Pay Commission recommendations for 'B' class cities w.e.f. 01.10.1986. It is not the case of the writ petitioners herein that the said Presidential order dated 08.01.1962 granting HRA, to the P&T staff posted in the State of Nagaland, at the rate applicable in 'B' class cities has been withdrawn. The similarly placed employees having been allowed the HRA at the said rate, the same cannot be denied to the respondents herein, they being posted in the State of Nagaland.
9. It also appears that some of the present respondents earlier approached the learned Tribunal in O.A. No. 279/1997 claiming that they are entitled to HRA at the rate applicable to 'B' class cities w.e.f. 01.03.1991, which was disposed of by the learned Tribunal vide order dated 31.05.2001 allowing the said prayer in terms of O.A. No. 231/2019 35 the earlier order of the learned Tribunal dated 22.08.1995 passed in OA No. 37/1995 and batch.
By the order dated 22.08.1995 passed in OA No. 37/1995 and batch, the learned Tribunal has held that the applicants therein are entitled to HRA at the rate applicable to the Central Government employees in 'B' class cities w.e.f. 01.03.1991 onwards and they shall be paid accordingly. The said orders of the learned Tribunal have not been challenged by the present petitioners, who were the respondents therein, in the higher forum.

Since the present respondents, who are posted in Kohima and Dimapur in the State of Nagaland, are entitled to the HRA at the rate applicable to the employees in 'B' class cities, they are to be paid HRA in the same rate, in view of Clause-3 of the office Memorandum dated 03.10.1997, until further orders are passed by the Central Government in that regard. For better appreciation Clause-3 of the Office Memorandum dated 03.10.1997 is reproduced below:-
"3. The cities/towns which have been placed in a lower classification in the above mentioned lists, as compared to their existing classification shall continue to retain the existing classification until further orders and the Central Government employees working therein will be entitled to draw the rates of CCA and HRA accordingly."
21. Against the said Order, the respondents therein/present respondents, had preferred an SLP before the Hon'ble Apex court vide CC 13260/2010 (Annexure-A/15), where the Hon'ble Apex Court vide their Order dated 01.09.2010 had dismissed the said SLP. O.A. No. 231/2019 36
22. We failed to understand, if according to the respondents, Aizawl had been classified as 'C' class city, then why the Ministry of Finance had accorded sanction to extend the benefit of HRA @ 'B' class city to the petitioners of aforementioned Original Application vide O.M. dated 01.03.2016 (Annexure-A/9) to the employees of Postal department as well as other different departments/Ministries, who are/were posted at Aizawl/Mizoram.
23. Therefore, in our considered opinion, Government cannot discriminate the employees working in same city by treating the same city in two categories for two sets of employees. However, since the applicants have not mentioned their period of working at Aizawl, therefore, we quash and set aside the Memorandum dated 17.09.2018 (Annexure-A/1), impugned Speaking Order dated 11.04.2019 (Annexure- A2) and direct the respondents to extend the benefits O.A. No. 231/2019 37 of the Order of this Tribunal dated 12.04.2002 passed in O.A. No. 381 of 2000 (Annexure-A/17) as well as Order dated 19.09.2017 passed in O.A. No. 044/00267/2017 (Annexure-A/7) and grant the consequential benefits, within a period of four months from the date of receipt of copy of this order, after verifying their period of posting in Aizawl, Mizoram.
24. O.A. stands disposed of with the above observations and directions with no order as to costs.
