3. The common issue involved in this batch of petitions is about the applicability of appropriate pension scheme. The petitioners are claiming that, they are governed by the old pension scheme, which was applicable till 31/10/2005 and not by the Defined Contributory Pension Scheme (DCPS), which replaced the old pension scheme w.e.f. 01/11/2005. Since the issue involved is common, for the sake of convenience, we have taken all the petitions together for disposal.

4. Mostly, this is a second round of litigation. Earlier, almost all the petitioners who were appointed by the Private Educational Institutions with their School/Junior Colleges on the post of Junior College Teacher/Junior Lecturer (Assistant Teacher), Lab Attendant and Lab Assistant, had approached to this Court seeking declaration of applicability of old pension scheme on the premise of consistent view expressed by this Court in the cases of Nilesh S/o. Namdev Gurav and ors. V/s. The State of Maharashtra and ors. with connected matters [Judgment of this Court in Writ Petition No. 4748/2019, decided on 01/10/2021] and Smt. Manasi Sudhir Mane V/ s. The State of Maharashtra and ors. with connected matters [Judgment of this Court in Writ Petition No. 8990/2021, decided on 11/04/2022].
5. The said batch of petitions was decided by this Court vide common order dated 08/12/2022, whereby the matters were relegated to the Deputy Director of Education/Education Officer (Secondary) to reconsider the applicability of old pension scheme in terms of above referred two decisions.

In pursuance thereof, by passing various orders, for example, the order dated 20/01/2023 in respect of petitioner Prashant Chimne (Writ Petition No. 4632/2023), the respondents declined to grant benefit of old pension scheme on the ground that, the division in which the petitioners were appointed, was not having grants on the cut of date i.e. 01/11/2005. Being aggrieved, all the petitioners have approached to this Court seeking multiple reliefs, principally for declaration of applicability of old pension scheme and consequential relief.

8. The issue involved in all these petitions is no more res integra. In the series of decisions, this Court has consistently expressed the view about the applicability of old pension scheme to the employees of schools/institutions working in fully aided schools prior to 01/11/2005. The respondents once again took a stand that, though the respective schools are fully aided, however, the petitioners were appointed on non-grant in aid division and thus, they are governed by New Pension Scheme called as DCPS. It is also the respondents' stand that the post which the petitioners held, received 100% grant in aid after 01/11/2005, therefore, they are governed by DCPS.
9. Notably despite, this Court in earlier round has specifically directed to consider the ratio in cases of Nilesh S/o. Namdev Gurav (supra) and Smt. Manasi Sudhir Mane (supra), without adhering to the law laid down in those decisions, the impugned orders have been passed reiterating that the concerned division was on non-
WP 4632-2023 and ors. WPs.odt 53/60 grant basis on the cut of date. The observations made by this Court in para 17 in the case of Nilesh S/o. Namdev Gurav (supra), reads as below:-
"17. It is noted that Respondents have in the Charts annexed to the said Affidavits singled out the case of Petitioner No. 6 in Writ Petition No. 4748 of 2019 by stating that he was an employee on unaided post. However, it is clear from the Government Resolution dated 19th July 2011 that what is to be taken into consideration is whether the educational institution is a fully aided educational institution, receiving 100% aid from the Government Resolution and not whether particular post is aided or not."
10. The issue was similarly resisted before this Court in the case of Purushottam Harishcandra Shirsekar and anr. V/s. The State of Maharashtra and ors. [Writ Petition No. 2538/2021, decided on 25/08/2021]. In the said decision, having regard to the earlier decisions including the reference answered by the Full Bench, this Court has observed in para 18 to 20 as below:-
"18. It has thus been a consistent view of this Court that the services of the employee of the Educational Institution is to be counted from the first date of appointment irrespective of whether it is on a part time or full time post. Further, if such appointment is prior to 1st November, 2005, then the old WP 4632-2023 and ors. WPs.odt 54/60 pension scheme would be made applicable to the employee. This requirement is further made clear from the Government Resolution dated 31st October, 2005 which provides in Clause 4 that the employees who are to be recruited on or after 1st November, 2005 in the services of the recognized and aided educational institutions, for them the new pension scheme (DCPS) is made applicable.
19. The decision of this Court in Deshmukh Dilipkumar Bhagwan (Supra) had referred certain questions to the full bench and one of the questions is material herein which is whether the employees appointed prior to 1st November, 2005 in aided recognized primary, secondary and higher secondary schools as well as colleges of education which were receiving less than 100% grant-in-aid as on 1st November, 2005 are entitled to the old pension scheme under the pension rules and the commutation of pension rules or whether they will be governed by the new pension scheme under the Government Resolution dated 31st October, 2005? This question along with two other questions have now been answered in the full bench decision in Deshmukh Dilipkumar Bhagwan (Supra). The Full Bench has made it clear that only those education institutions receiving 100% grant-in-aid can be termed as aided institutions. The employees appointed prior to 1st November, 2005 in aided educational institutions but receiving less than 100% grant-in-aid as on 1st November, 2005 would be governed by the new pension scheme (DCPS).

20. Thus it is clear that employees such as Petitioner No.1 who were appointed prior to 1st November, 2005 in aided educational institution receiving 100% grant-in-aid as on 1st November, 2005 would be governed by the old pension scheme. This has further been made clear by the Division bench in Deshmukh Dilipkumar Bhagwan (Supra) along with companion matters, decision dated 26th August, 2019 (Coram Pradeep Nandrajog, CJ and Smt. Bharati Dangre, J.). It has been held therein that employees of schools, including colleges of education working against fully aided, i.e. 100% aided post prior to 1st November, 2005, irrespective of the nature of the initial appointment would be governed by the old pension scheme. We do not find any merit in submission of the learned AGP that the employee must not only be appointed prior to 1st November, 2005 but the post against which the employee is appointed must also be a full time fully aided post for making the old pension scheme applicable to such employee. The impugned order has only referred to a Government Order which it alleges provides for such requirement. However, the said Government Order has neither been produced nor any particulars of the same has been given. Further the Government Order relied upon in the impugned order cannot be contrary to what has been laid down in the decisions of this Court including the decision of the Full Bench in Deshmukh Dilipkumar Bhagwan (Supra)."

11. It is evident that, in the case of Nilesh S/o. Namdev Gurav (supra), this Court has held that the Government Resolution dated 31/10/2005 and in particular, Clause-4 thereof lays down that it is only those employees who are recruited on or after 01/11/2005 in the services of the recognized and aided educational institutions would be governed by the new pension scheme. However, it is held that the employees appointed prior to cut of date in aided educational institutions receiving 100% grant-in-aid shall be governed by the old pension scheme. In the decision of Purushottam Harishcandra Shirsekar (supra), it is clarified that, if the school employee is appointed on a post which is sanctioned on part time basis, still he is governed by the old pension scheme.
Further, it is clarified that, the employees appointed prior to cut of date on unaided post but if the school has been receiving 100% aid on the cut of date, then those employees are governed by old pension scheme.
12. This issue fell for consideration in various subsequent petitions wherein consistently it has been ruled that irrespective of the division, if the School is receiving 100% grant on cut of date and WP 4632-2023 and ors. WPs.odt 57/60 the employees are appointed prior to the said date, they are governed by the old pension scheme. To quote few, such view is reiterated by this Court in cases of Prabha V/s. State of Mah. and ors. [Writ Petition No. 5463/2021, decided on 23/06/2022], Rajesh S/ o. Anant Tumsare V/s. State of Mah. and ors. [Writ Petition No. 4338/2022 along with connected matters, decided on 29/07/2022], Nilima Harishchandra Katole and ors. V/s. State of Mah. and ors.

13. We have no reason to deviate from the consistent view expressed by this Court. The petitioners have pleaded that, they have been appointed prior to the cut of date and the School/Institution was receiving 100% grant prior to 01/11/2005.
The said factual aspect has not been disputed by the respondents/State. In view of that, the petitioners are squarely governed by the old pension scheme. Needless to say that the petitioners who are retired, are entitled for retiral benefits as per old pension scheme.
14. In view of above, by allowing all petitions, we proceed to pass the following order:-
ORDER
i) Writ Petitions are allowed.
ii) The Petitioners are entitled to be governed under the old pension scheme i.e. Maharashtra Civil Services (Pension) Rules, WP 4632-2023 and ors. WPs.odt 59/60 1982 and Maharashtra Civil Services (Communication of Pension) Rules, 1984 and provisions of General Provident Fund is applicable to Petitioners who are either Assistant Teachers or Non-Teaching employees, appointed prior to 1st November 2005.
iii) The respondent(s) shall extend the benefits of the old pension scheme to the petitioners and shall not deduct any amount from the salary of the petitioners by applying the DCP Scheme (New Pension Scheme). In the event, any amount has been deducted by applying the DCPS, such amount shall be refunded to the petitioners within a period of four weeks from the receipt of this order.
iv) The respondents shall allot the General Provident Fund Account (GPF Account) to the petitioners and thereafter, permit the educational institutions to deduct the amount of monthly compensation from the monthly salary of the petitioners and deposit the same in the said GPF Account which shall be done within a period of six weeks from the receipt of this order.

v) The Management is directed to submit the pension proposal
as regards to the eligible retired employees and to take necessary steps thereof.
vi) Rule is made absolute in the above terms with no order as to costs.
