THE HON'BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY
WRIT PETITION No.20808 of 2022
ORDER:-
This Writ Petition for mandamus is filed to declare the action of the respondents - police officials in calling the petitioners to the Police Station and threatening them to confess that they involved in the incidents that occurred in Konaseema District on 24.05.2022, as illegal and consequently sought direction to the respondents not to take any coercive steps against the petitioners.
Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home appearing for respondents 1 to 9.
Certain incidents relating to mob attack on the houses of the representatives of the people and the public property took place on 24.05.2022 in connection with the agitation that took place in the Konaseema District. The grievance of the writ petitioners is that the police are summoning the petitioners to the Police Station and insisting them to confess that they are involved in the said incidents to implicate them falsely in a criminal case that was registered in connection with the said incidents.
Learned Assistant Government Pleader for Home, on instructions, would submit that during the course of inquiry the police only summoned the petitioners to ascertain whether they have participated in commission of the said offences or not and their inquiry revealed that the petitioners did not participate in commission of the said offences. Therefore, he would submit that the petitioners are not accused in the crime registered in 2 connection with the said incidents and that they are no more required for the police in connection with the said crime.
Therefore, recording the aforesaid submission of learned Assistant Government Pleader for Home on instructions, the Writ Petition is closed. No costs.
Miscellaneous petitions, if any pending, in the Writ Petition, shall stand closed.
