1. The respondent No.4 in its reply has raised the question of maintainability of writ petition on the ground that respondent No.4 is not amenable to writ jurisdiction of this Court.
2. Relying upon judgment of Hon'ble Supreme Court in 'Rajbir Surajbhan Singh Vs. Chairman, Institute of Banking Personnel Selection, Mumbai' 2019 (5) JT 35 and Division Bench judgment of this 1 of 2 ::: Downloaded on - 22-11-2023 23:38:01 ::: Neutral Citation No:=2023:PHHC:147633 CM-19593-CWP-2023 -2- IN/AND CWP-9429-2021 2023:PHHC:147633 Court in 'Institute of Banking Personnel Selection Vs. Lakhan Verma and others' LPA No.1597 of 2019 decided on 11.11.2020, this Court vide order dated 03.11.2023 in CWP-24799-2023 has held that writ petition is not maintainable against Institute of Banking Personnel Selection.
2. Faced with this, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to avail remedies as permissible by law.
3. Disposed of with aforesaid liberty.
