(1)The panchayat shall, when a vacancy exists nominate a person to be a chaukidar under this Act, and the State Government shall, if satisfied with such nomination appoint such nominee to be chaukidar:Provided that if the panchayat fail to nominate within a reasonable time a person to be a chaukidar, or the State Government is not satisfied with such nomination, the State Government shall appoint any person [it] thinks fit to be a chaukidar.]
