ORAL ORDER
3 19-01-2026Heard learned counsel for the petitioner and Mr. Chandra Bhushan Prasad, learned APP for the State.
2. The S.H.O. and the Investigating Officer of the case were directed to remain physically present in the Court by order dated 13.01.2026. The S.H.O. is present in the Court and submits that the Investigating Officer on account of some personal reason could not come to the Court. The S.H.O. seeks four weeks' time for recovering the victim.
3. Put up this case on 16.02.2026 at 12:45 p.m.
4. It is made clear that if victim is recovered then personal appearance of the S.H.O. and the Investigating Officer shall not be required but if the victim is not recovered by then, Patna High Court CR. MISC. No.80951 of 2025(3) dt.19-01-2026 2/2 the S.H.O. and the Investigating Officer of the case shall remain physically present before the Court on the said date.
5. It is also made clear that if victim is not recovered, then on the said date, i.e., 16.02.2026, the Court may consider the desirability of summoning the Superintendent of Police, Sitamarhi.
6. At this stage, the S.H.O., who is present in the Court, submits that during the course of investigation, it transpired that victim fled with Navin Rai to Nepal as she was in love with him. It is next submitted that victim is in Nepal, as such, time is required for recovering her.
7. At this stage, the learned counsel appearing on behalf of the petitioner submits that when it is being submitted by the S.H.O. that the victim eloped with Navin Rai and is in Nepal then why the police sought process under Section 82 Cr.P.C. against the petitioner knowing that it is not a case of kidnapping.
