ORDER
Background
1. The Applicant filed an RTI Application dt.14.9.11 with the PIO, DRM Office, East Central Railway, Danapur seeking information against ten points including whether any enquiry is being conducted against Shri Udai Paswan who has become gangman and is getting higher salary than a coolie, name of father and address in respect of Shri Ram Pravesh Prasad, Coolie who has apparently bought the coolie badge from Shri Paswan , documents submitted by Shri Udai Paswan at the time of his appointment of gangman etc. The PIO replied on 21.9.11 informing the Applicant that information is being collected and will be supplied soon. On not receiving any further response , the Applicant filed an appeal dt.23.1.12 with the Appellate Authority and on not receiving any reply even from the FAA he filed a second appeal dt.26.6.12 before CIC. Decision
2. During the hearing, the Appellant submitted that information which was furnished on 4.2.13 was received by him on 26.2.13. He added that information provided is incomplete and requested for information against points 6 and 8, which according to him is incorrect and incomplete.
3. With regard to point 6, the Respondent submitted that there is no separate seniority list for coolies and that the list as available at the station has been provided. The Commission while holding that available information has been furnished, however, in the interest of the Appellant directs the PIO to allow the Appellant to inspect the records in respect of point 6 on a mutually convenient date and time so that he can verify the authenticity of information provided to him. This exercise to be completed within four weeks of receipt of this order.
4. As for point 8, the Commission directs the PIO to supply the documents submitted by Shri Udai Paswan at the time of his appointment as a Gangman since the same cannot be considered as personal as they are the basis on which Shri Paswan was given the appointment by the Public Authority. The information to reach the Appellant within three weeks of receipt of this order.
5. The appeal is disposed off with the above directions.
