1. The issues under consideration arising out of the second appeal dated 23.01.2019 include non-receipt of the following information raised by the appellant through his RTI application dated 29.08.2018 and first appeal dated 21.10.2018:-

i. What is the MCLR (in %), spread and effective interest rate as on 28.06.2017 for home loan account no. ********495?

ii. What is the MCLR (in %), spread and effective interest rate as on 29.06.2017 for home loan account no. ********495?

iii. What is the MCLR (in %), spread and effective interest rate as on 28.06.2018 for home loan account no. ********495?

iv. What is the MCLR (in %), spread and effective interest rate as on 29.06.2017 for home loan account no. ********495?

2. Succinctly facts of the case are that the appellant filed an application dated 29.08.2018 under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), State Bank of India, Bhopal Circle, seeking aforesaid information. Dissatisfied with the non-response of the CPIO, the appellant filed first appeal dated 21.10.2018. The First Appellate Authority (FAA) disposed of the first appeal vide its order dated 14.11.2018, instructing the CPIO to give reply in 15 days. Subsequently, The CPIO replied on 07.12.2018. Aggrieved by this, the appellant filed a second appeal dated 23.01.2019 before this Commission which is under consideration.

3. The appellant has filed the instant appeal dated 23.01.2019 inter alia on the grounds that reply given by the CPIO and the FAA was not satisfactory. The appellant requested the Commission to direct the CPIO to provide the complete information and take necessary action as per Section 20 (1) of the RTI Act.

4. The CPIO did not reply to the RTI application within the stipulated time period. The FAA vide his order dated 14.11.2018 instructed the CPIO & Regional Manager, RBO - 4, Dewas to send the reply within 15 days of receipt of FAA's order. After FAA's compliance, the CPIO vide its letter dated 07.12.2018 provided point wise response to the appellant.

5. The appellant remained absent and on behalf of the respondent Shri Shiv Kumar Koshare, Regional Manager, State Bank of India, Dewas, attended the hearing through video conference.

5.1. The respondent while defending their case inter alia submitted that the appellant sought information regarding MCLR (in %), spread and effective interest rate in his home loan account in different dates which had already furnished to the appellant vide their letter dated 20.09.2018. However, the appellant in his first appeal contended that no Page 2 of 3 reply/information was received by him. Accordingly, in compliance of the FAA's order, they again provided the desired point-wise information/reply to the appellant vide letter dated 07.12.2018.

The Commission after adverting to the facts and circumstances of the case, hearing the respondent and perusal of records, observed that due reply has been given by the respondent vide their letters dated 20.09.2018 and 07.12.2018. Further, the appellant neither filed any written objection nor appeared before the Commission to controvert the averments made by the respondent and further agitate the matter. Hence, the submissions of the respondent are taken on record. The Commission feels that no public interest would be served in further prolonging the matter. Accordingly, the appeal is dismissed.
