63. Issue of show cause notice before confiscation under section 62.
(1)No order confiscating any vehicle or conveyance shall be made under section 62, except after notice in writing to the person I from whom it is seized and the registered owner thereof, and considering their objections, if any.(2)Without prejudice to the provisions of sub-section (1), no order confiscating any vehicle or conveyance shall be made under section 62 of this Act, if the owner of such vehicle or conveyance proves to the satisfaction of the Excise Officer-in-charge of the district that it was used in carrying the liquor without the knowledge or connivance of the owner himself, his agent, if any, and the person-in-charge of such vehicle or conveyance and that each of them had taken all reasonable and necessary precautions against such use :Provided that the confiscation made under section 62 of this Act shall not affect the punishment of the accused for the offence for which he is liable under this Act.
