Heard learned counsel for the petitioner, Sri Savitra Vardhan Singh, learned counsel for the respondent no.1 and Sri Deeraj Awasthi, Advocate holding brief of Shri Devak Vardhan, learned counsel for the respondent and Standing Counsel.
It is argued that the present petition was filed with the following prayers:-
(a) To issue a writ, order or direction in the nature of Certiorari quashing the impugned order dated 09.07.2019 passed by the opposite party no.1, the true copy of which is contained as Annexure No.1 to the writ petition.
(b) To issue a writ, order or direction in the nature of Mandamus commanding and directing the opposite parties 1 and 2 to allow the petitioner Institution i.e. Hayat Unani Medical College and Research Centre, Haodoi Road, Sikrori, Kakori Lucknow, U.P. in the tentative time schedule for online counseling (allotment process) for NEET 15% AIQ private Institutions BAMS Seats 2019-20.
(c) To issue a writ, order or direction in the nature of Mandamus commanding and directing the opposite parties to allow the Petitioner Institution i.e. Hayat Unani Medical College and Research Centre, Haodoi Road, Sikrori, Kakori, Lucknow, U.P. to undertake admissions of 60 students in BUMS for academic Session 2019-20, the impugned order dated 09.07.2019 notwithstanding.
(d) To issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to show the petitioner Institution for registration/payment and choice filling at online counseling (allotment process) for BUMS Seats 2019-20 for 60 intake capacity.
When the petition was entertained, this Court had passed a detailed order on 01.08.2019.
It is informed at bar that in similar circumstances the matter in issue is squarely covered by the judgment of this Court dated 18.02.2022 passed in Writ - C No.21139 of 2019 in Re: Snsk Ayurvedic Medical College and Hospital versus Union of India and others.
Considering the fact that the fact is squarely covered by the said judgment, the instant petition is disposed of on the same terms and conditions and the observations as contained in Writ -C No.21139 of 2019 in Re: Snsk Ayurvedic Medical College and Hospital versus Union of India and others, the benefit as flow go to the petitioner in the said writ petition shall be available to the petitioner also.
