UPON hearing the counsel the Court made the following O R D E R
1. We have heard learned counsel for the parties.
2. By this petition, the petitioner seeks leave to appeal against an interim order dated 28.04.2025 whereby the High Court has stayed the effect and operation of the arbitral award subject to deposit of 50% of the awarded amount and has also fixed a date for disposal of the appeal, which happens to be 22.07.2025.

Having regard to the date fixed by the High Court for final Digitally signed by BORRA LM VALLI Date: 2025.07.17 disposal of the appeal, we decline to exercise our jurisdiction 16:45:11 IST Reason:

under Article 136 of the Constitution of India. 1

We, therefore, dispose of this Special Leave Petition by making an observation that the observation of the High Court with regard to the claim being barred by limitation as also on other aspects, concerning the merits of the award, while dealing with the stay application, shall not be taken as a binding opinion while deciding the appeal on merits. It is also clarified that if the appeal remains pending for long, it would be open for the petitioner to apply for discharge of the interim order as also for withdrawal of the amount deposited under the interim order.
5. With the aforesaid observations / liberty, this petition is disposed of.
6. Pending application(s), if any, shall stand disposed of.
