72. Payment of compensation to owner of surface rights, etc
.- [(1) The holder of a reconnaissance permit or prospecting license or mining lease shall be liable to pay to the occupier of the surface of the land over which he holds the reconnaissance permit or prospecting license or mining lease, as the case may be, such annual compensation as may be determined by an officer appointed by the State Government by notification in this behalf in the manner provided in sub-rules (2) to (4).] [ Substituted by G.S.R. 56(E), dated 17.1.2000 (w.e.f. 18.1.2000).](2)In the case of agricultural land, [* * *] [ Certain words omitted by G.S.R. 908(E), dated 19.10.1989.] the amount of annual compensation shall be worked out on the basis of the average annual net income from the cultivation of similar land for the previous three years.(3)In the case of non-agricultural land, the amount of annual compensation shall be worked out on the basis of average annual letting value of similar land for the previous three years.(4)The annual compensation referred to in sub-rule (1) shall be payable on or before such date as may be specified by the State Government in this behalf.
