2 16-10-2023Heard Mr. Kundan Rathore @ Kundan Kumar, learned counsel appearing on behalf of the petitioner and Mr. Rajiv Nayan, learned APP for the State.
2. Petitioner seeks pre-arrest bail in connection with Muffasil P.S.Case No.696 of 2022, registered for the offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.
2. Prosecution story, in brief, is that during the course of verification of certificates of the petitioner for appointment as the Gram Panchayat Teacher, Raj Ramgarhwa in the year, 2019- 2020, CTET/BTET certificates of the petitioner was found to be forged one, as a result, the Secretary of Panchayat Teacher Employment Unit cum Panchayat Secretary, Gram Panchayat Raj Ramgarhwa got registered the present case against the petitioner.
3. Learned counsel appearing on behalf of the Patna High Court CR. MISC. No.61589 of 2023(2) dt.16-10-2023 2/2 petitioner submits that the petitioner is not involved in committing forgery rather the husband of the petitioner had obtained the forged certificate to get her selected as Panchayat Teacher. He further submits that the forgery of the certificate was detected at the time of counselling. On these grounds, he seeks bail on behalf of the petitioner.
4. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.
5. Considering the aforesaid submissions made on behalf of the petitioner as well as the fact that the alleged forgery was committed by the husband of the petitioner, the petitioner is directed to be released on pre-arrest bail, in the event of her arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Muffasil P.S.Case No.696 of 2022, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
