Information soughtand background of the case:
The Complainant filed an RTI application dated 16.02.2023 seeking information on following points:-
"RTI Application is annexed as pdf file for obtaining the desired information from the following offices - Points (1) to (9) pertains to O/o Regional Director (North), ASI.
Points (10) to (18) pertains to various CPIOs of ASI HQ. Points (19) to (27) pertains to CPIO, ASI Delhi Circle.
(1) Diary number with date of letter numbered DDE/C&ND/PB/ASI/2022/316-20 dt. 07-07-22 received by PA to Director (RD) as per records of 0/0 Regional Director (North).
(2) (a) Copy of the information pertaining to the movement of the file for taking action on the above mentioned letter. (2) (b) Copy of the notesheet of the above mentioned file.Page 1 of 4
(3) Information regarding the speed/regd post consignment number vide which reply on the above mentioned letter was forwarded to Dy. Director of Education (C/ND) by O/o Regional Director (North), ASI.
(4) (a) Date of receipt of NCR numbered 0037/2022 dt. 24-
11-22 from Delhi Police/ASI Delhi Circle to O/o Regional Director (North), ASI.
(Provide information taken on record after 11-1-23). (4) (b) Copy of the letter written to higher officials of ASI HQ/ officials of Delhi Circle after the receipt of above mentioned NCR in O/o Regional Director (North), ASI. (Provide information taken on record after 11-1-23). Etc..."
The CPIO, ASI Delhi circle vide letter dated 24.03.2023 replied as under:-
"19. No reply/action taken after the meeting dated 03.08.2022.
20. ASI, Delhi Circle has received no representation from Education Deptt. after the meeting of 03.08.2022 for taking further action in this regard.
However at present day the officer who represented ASI, Delhi Circle for the said meeting of 03.08.2022 is retired.
21. Copy enclosed with all the signature.
22(a) & (b). Information in this regard available. Etc."
Aggrieved by reply received from the CPIO, the Complainant filed a First Appeal dated 02.06.2023. The FAA, Delhi Circle vide order 06.07.2023 dated upheld the reply furnished by the PIO Aggrieved and dissatisfied, the Complainant approached the Commission with the instant Complaint.
Written submission dated 03.04.2024 has been received from the CPIO, Delhi Circle as under :
With reference to your Second appeal CIC/ALSOI/C/2023/627033 dated 22.03.2024 which is due for hearing before Hon'ble Central Information Commissioner Mr. Heeralal Samariya on 16.04.2024 at 11:55AM received by this office on 28.03.2024 on the subject cited above, it is to mention that CPIO, ASI, Delhi Circle had already provided the information to the applicant on 24.03.2023 (Copy enclosed). Also as per the record it may be mentioned that the response of the first appeal (ALSOI/A/E/23/00100 dated
02.06.2023) of the appellant had also been disposed off by this office on 06.07.2023, the copy of which is enclosed. However the required Page 2 of 4 information as available as per the record and as forward to the applicant is once again submitted for the kind perusal of Hon'ble Central Information Commissioner:-
"...19. No reply/action taken after the meeting dated
03.08.2022.
20. ASI, Delhi Circle has received no representation from Education Deptt. after the meeting of 03.08.2022 for taking further action in this regard.

A letter dated 14.04.2024 has been received from the Complainant whereby he has expressed his willingness to withdraw the instant Complaint.
Facts emerging in Course of Hearing:
Complainant: Absent Respondent: Mr. Naresh Chand, Dy. Superintending Horticulturist, O/o Regional Director (North ASI and Ms. Debarati Mitra Rawat, Assistant Superintending Archaeologist - participated in the hearing.
An email dated 14.04.2024 has been received from the Complainant whereby he has expressed his willingness to withdraw the instant Complaint.
Decision:
In view of the request made by the Complainant, the instant Complaint is closed as withdrawn.
Complaint is disposed of accordingly.
