Background
1. The Applicant filed an RTI application dt.3.4.08 with the CPIO, D/o AYUSH.
He requested for the following information:
i) What action has been taken on his letter dt.29.7.07.
ii) Copies of the relevant note sheet are also required on which his letter dt.29.7.07 was put up and decision taken thereon
iii) He also wants to know why the Council did not enclose the following along with the final order issued to him:
a) copy of the findings on each article of charge
b) copy of the advice given by the CVC
c) where the Council being a disciplinary authority has not accepted the advice of CVC on any part of the advice of CVC.
The CPIO replied on 3.6.08 providing para wise information. Not satisfied with the reply, the Applicant filed an appeal dt.11.7.08 with the Appellate Authority. The Appellate Authority replied on 30.7.08. Aggrieved with the reply, the Applicant filed a second appeal dt.5.9.08 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for April 20, 2009.
3. Mr.Lakshmi Kanta Ganguly, Administrative Officer represented the Public Authority.
4. The Applicant was present in person during the hearing.
Decision
5. The Appellant stated that he wanted to know the reasons for not enclosing copies of documents mentioned in points (a) (b) and (c) in the RTI request along with the final order of the disciplinary proceedings. The Respondent replied that the reasons are not available since no such information/file notings exist on the subject.
6. Since there is no information to be given, the appeal is accordingly disposed off.
