By means of this petition under article 226 of the constitution, the petitioner has assailed the order dated 17.10.2019 on the pleadings that have come to be raised in paragraphs-20 and 21 of the writ petition.
The basic grievance of the petitioner is that he has never been informed about the draw of lotts being conducted on 15th of February, 2019 as has come to be stated in the order impugned.
In our considered opinion, once the draw of lotts has been conducted by the respondent-corporation which is a kind of lottery system, whereby a person comes to be selected randomly, no grievance can be raised about the conduct of the proceedings unless there are charges of malafides on the part of a particular officer involved in such draw of lotts. In none of the grounds that have been raised as ground no. 1 to ground no. 9 we find any such charge being levelled nor, any official has been impleaded by name so as to make out a case of malafides. The pleadings that have come to be raised in paragraphs-20 and 21 is only with regard to the non information being furnished as the e-mail account of the petitioner did not receive the mail generated by the respondent-corporation. We cannot go into these questions of fact about the delivery of mail on the mail account of the petitioner. Suffice it to say that the draw of lotts have been conducted in which petitioner's name was included and there are no charges of malafides and manipulation at the end of the corporation. We do not find any error in the selection process.
The writ petition fails and is, accordingly, dismissed.
