Information soughtand background of the case:
The Appellant filed an RTI application dated 11.06.2024 seeking information on following points:-
"The information requested pertains to Rules 3(2), 5, and 6 of the Criminal Procedure (Identification) (CPIA) Rules of 2022. These rules delegate power to the National Crime Records Bureau (NCRB) to formulate a Standard Operating Procedure (SOP) concerning the collection, storage, processing, sharing, dissemination, and destruction of records of measurements.
1. Please state if the NCRB has issued any such SOP/Guidelines regarding collecting, storing, processing, sharing, disseminating, and destroying records of measurement under Rules 3(2), 5 and 6 of the CPIA Rules.
2. If yes, please share a copy of the same."
The Dy. Director & CPIO vide letter dated 08.07.2024 replied as under:-
"In this regard, please refer to the Act and Rules at the link given below:
https://www.indiacode.nic.in/handle/123456789/19029?sa m_handle=12 3456789/1362 Page 1 It is also informed that the information sought by you is exempted from disclosure under Section 8(1) (j) of the Right to Information Act 2005."
Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 07.08.2024. The FAA vide order dated 05.09.2024 upheld the reply of CPIO.
Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal.
Written submission dated 18.07.2025 has been received from the CPIO and same has been taken on record for perusal. The relevant extract whereof is as under:
1. Shri Ashlesh Biradar submitted his online RTI Application No. NCREB/R/E/24/00510 dated 11.06.2024.
a) Above RTI Application was replied to on 08.07.2024 informing that
(i) he may please refer to the Act and Rules at the link https://www.indiacode.nic.in/handle/123456789/19029?sam handle=12 3456789/1362 and (ii) the information sought by you is exempted from disclosure under Section 8(1)(j) of the Right to Information Act 2005.
2. Shri Ashlesh Biradar raised his 1st Appeal No. NCREB/A/E/24/00088 dated 07.08.2024. FAA replied to the applicant on 05.09.2024 that (i) your RTI Application was appropriately answered and (ii) as regards the SOP, it is informed that since it deals with the collection and processing of personal information of persons, it is exempted from disclosure under section 8(1)(j) of RTI Act 2005.
3. Shri Ashlesh Biradar made his 2nd Appeal to CIC, which was received in NCRB on 02.07.2025.

In this regard, it is submitted that since the SOP sought about records of measurement relates to biometric data of arrested and convicted persons as mandated by CrP(I) Act 2022, and it is a restricted document only to be circulated to the authorised users of CrP(I) system, it is exempted from disclosure under Section 8(1)(j) of the RTI Act 2005.
5. It may also be noted that, the role of the NCRB under the CrP(I) Project focuses primarily around planning, monitoring and providing the Application Software to States. Since Police is a State subject under the 7th Schedule of the Constitution of India, States drives the implementation at the State level and have continued to own the data after deployment.
Facts emerging in Course of Hearing:
Appellant: Not present Respondent: Mr. Prashun Gupta, Dy. Director, NCRB- participated in the hearing.
Page 2 The Respondent reiterated the averments made in their written submission and stated that the information sought by the Appellant is sensitive and confidential in nature. He averred that SOP is a restricted document only to be circulated to the authorised users of CrP(I) system and same is exempted from disclosure under section 8(1)(a) of the RTI Act. He further stated that since SOP deals with the collection and processing of personal information of persons, it is exempted from disclosure under section 8(1)(j) of RTI Act 2005. He further stated that copy of their written submission dated 18.07.2025 has already been furnished to the Appellant.
Decision:
Upon perusal of records and submissions made during hearing, it is noted that the Appellant's queries had been appropriately answered by concerned PIO. Furthermore, written submission filed by the Respondent is comprehensive and self-explanatory. Thus, information as permissible under the provisions of the RTI Act has been duly furnished to the Appellant. In the given circumstances, no further intervention of the Commission is warranted in this case under the RTI Act. The appeal is disposed of accordingly.
