                             Response to showcause notice


1.     The para 7 of the above mentioned decision is as follows:


       The Commission also directs the CPIO to show cause as to why a penalty of Rs.250/-
       per day (Maximum Rs.25000) should not be levied on him for not responding to the
       RTI application within the stipulated time prescribed under the Act despite the
       Appellant having deposited Rs.30/- as sought by him. The CPIO is directed to submit
       the explanation in person on 16.12.09 at 11.15 am.


2.     The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing
       for December 16, 2009.
3.     Shri g.n.Dubey, CPIO and Shri A.K.Tewari, O/A represented the Public Authority.
4.     The Appellant was present during the hearing.


Decision

5.     To the Appellant's charge that Rs.30/- was returned late, the Respondent submitted

that it was returned on the same day on which the decision of CIC dt.11.11.09 was received by them.

6. In view of the submission made by the Respondent that he had joined as the CPIO and was on training at Ghaziabad at the time of receipt of RTI application, the Commission gives one more chance to the CPIO to provide explanation for the delay in responding to the RTI application. The written submission should reach the Commission by 16.1.2010.

7. The case is accordingly disposed off.
