The present appeal has been filed for enhancement of the compensation awarded vide award dated 27.01.1989 passed by the Arbitrator, (Additional District Judge, Gurdaspur). Vide the impugned award, the Arbitrator awarded Rs.350/- per marla.

In the connected Letters Patent Appeal No. 658 of 1983, the amount of compensation was fixed at Rs.350 per marla, which was subsequently upheld up till Hon'ble the Supreme Court and the Special Leave Petition titled as Union of India v. Hari Krishan Khosla, JT 1992 (5) SC 574 FAO No. 571 of 1989 2 arising out of the aforesaid LPA was dismissed.

Learned counsel for the appellants, however, prays that the awarded amount of compensation is inadequate and it should be enhanced by Rs.500/- per marla. However, no case for enhancement is made out.

Since the awarded amount of compensation i.e. Rs.350/- per marla has already been upheld up till Hon'ble the Supreme Court and the ground for further enhancement is not made out, the present appeal is accordingly dismissed.
