Section 37 in The Constitution of Jammu and Kashmir
37. Minister's responsibility to the Legislature.
(1)The Council of Ministers shall be collectively responsible to the Legislative Assembly.(2)A Minister who for any period of six consecutive months is not a member of either House of Legislature shall upon the expiry of that period cease to be a Minister.
