Section 5(3)(a) in The West Bengal Medical And Dental Colleges (Regulation Of Admission) Act, 1973

(a)if the required number of candidates belonging to the Scheduled Tribes and fulfilling the requisite qualifications are not available the seats remaining vacant shall be filled by candidates belonging to Scheduled Castes who fulfil such qualifications and vice versa, and
