WRIT PETITION NO.2977 OF 2016
ORDER:(per SK,J) The State of Andhra Pradesh and its authorities in the Education Department filed this writ petition aggrieved by the order dated 09.12.2015 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.4387 of 2015. The said O.A. was filed by the first respondent herein assailing the proceedings dated 13.03.2015 and the consequential rejection order dated 27.06.2015 passed by the District Educational Officer, SPSR Nellore District. She sought a consequential declaration that she was entitled for notional seniority and increments from the date of appointment of the last O.C. candidate of DSC 2008 with all consequential benefits. By order dated 09.12.2015, the Tribunal allowed the O.A. By order dated 19.10.2016, this Court granted interim stay of further proceedings pursuant to the order under challenge. W.V.M.P.No.1775 of 2017 was filed by the first respondent-applicant to vacate the said order.
Sri K.Raghavendra Venkatesh, learned counsel for the first respondent-applicant, would inform this Court that the issue arising for consideration in this writ petition is squarely covered by the decision of this Court in W.P.No.19413 of 2015. A copy of the order dated 03.10.2017 passed in W.P.No.19413 of 2015 is placed on record.
Learned Government Pleader for Service, State of Andhra Pradesh, appearing for the petitioners, fairly concedes that the present writ petition 2 would be squarely covered by the aforestated decision which held against the authorities.
For reasons alike as were mentioned in the aforestated order and in terms thereof, this writ petition is dismissed.
Interim order dated 19.10.2016 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
