1. The petitioner has no objection to this Court hearing the matter.
2. This is a petition filed under Section 34 of the Arbitration and Conciliation Act, 1996 ("the Act"), seeking to challenge the Award dated 05.07.2025.
3. Mr. Kumar, learned counsel for the petitioner amongst other grounds, states that the Arbitrator has re-written the terms of clause 5(C)(ii) of the Maintenance Agreement dated 18.12.2015 which states that the petitioner is liable to the refund of IFMS deposit after adjustment of outstanding dues of respondent, including CAM charges, electricity charges and other dues. Further it is stated that while rejecting the counter claims of the petitioner, the Arbitrator has gone beyond the Clause Nos. 15.12 and 17 of the Lease Deed dated 22.12.2016.
4. For the said reasons, issue notice.
5. Mr. Tomar, learned counsel for respondent accepts notice, seeks and is granted 4 weeks to file a reply.
