Mr. Subhrangsu Panda Ms. Mithu Singha Mahapatra .....For the Petitioner Mr. Saibal Acharya Mr. Arka Bhattacharya ......For the School The petitioner applied for transfer from his present school to another school on 25.08.2021 i.e. after coming into force of the Government Notification dated 22.09.2021. The said application came back to the petitioner from the end of the Head of the Institution on 26.01.2021.
In view of the Government order dated 22.09.2021, the matter is to be looked into by the District Inspector of Schools and the school has not been given any authority to send back or reject the application of a teacher. Under the said Notification the school is required to send the application of the petitioner to the District Inspector of Schools.
I direct the school to send the application of the petitioner to the District Inspector of Schools immediately by 25th April, 2022. The school has not given any no-objection certificate to the petitioner. I 2 also direct the school to give the no-objection certificate and also upload it in the Utsashree Portal so that the N. O. C. and the application of the petitioner can be sent to the D. I. of Schools at the same time.
Under the said Notification dated 22.09.2021 the D. I. of Schools has been directed, inter alia, to make any local arrangement in respect of the post where the petitioner is working as a teacher.
I direct the D. I. of Schools to make an endeavour in making local arrangement as per Government Order dated 22.09.2021 within three months. The D. I. of Schools will intimate the result of his endeavour in making local arrangement to the petitioner in writing. If any local arrangement is made in the meantime before the said three months, the D. I. of Schools will take steps in accordance with said Notification dated 22.09.2021.
With the above direction and observation this writ application is disposed of.
