ORDER
1. In this Original Application the Tribunal is considering the issue of infrastructure, resources and capacity of the State Pollution Control Boards (PCBs)/Pollution Control Committees (PCCs) as there is an allegation that these Boards and Committees are not able to perform properly on account of inadequate facility, not filling up the post against the sanctioned strength, high number vacancies specially in technical position, absence of proper training, lack of pollution monitoring and abatement equipments and absence of technically competent leadership.
2. In response to the notice issued by the Tribunal, the replies have been filed by the different PCBs/PCCs. The CPCB has compiled the information in tabulated form and has filed the report dated 09.04.2026.
The position relating to infrastructure facility available for monitoring of environmental parameters is disclosed in Table 1 of the report as follows:-

5. It has been pointed out that the Jharkhand PCB has not filed response till now. No one is present on behalf of Jharkhand PCB. Therefore, we require the Member Secretary, Jharkhand PCB to appear virtually and assist the Tribunal on the next date of hearing.
6. A perusal of the above tables reveal that the PCBs and PCCs do not have the requisite facilities and in almost all the PCBs/PCCs the gaps are existing. Hence, we require each of the PCBs/PCCs to respond to the above disclosure of the CPCB and point out the reason for not having the optimum prescribed facilities. Let the response affidavit be filed within four weeks. The Applicant also seeks four weeks' time to file the objection to the report of the CPCB.
7. In the meanwhile, the concerned PCCs, PCBs and State Authorities to take expeditious steps to ensure that the requisite facilities are created and vacant posts are filled up.
