02. Heard Mr. S. Mohapatra, learned counsel for the petitioner and Mr. P. Mohapatra, learned Additional Standing Counsel through video conferencing mode.

According to Mr. S. Mohapatra, the petitioner is aggrieved by the non-registration of her F.I.R. under appropriate provisions of law by the I.I.C., Khaira Police Station (opposite party No.4). According to him, the F.I.R. should also have been registered under Section 376(1) of I.P.C. along with Section 3 of Scheduled Castes and & Scheduled Tribes (Prevention of Atrocities) Act, 1989 in the facts and circumstances of the case.

During course of hearing, Mr. S. Mohapatra submits that liberty may be granted to the petitioner to move the Superintendent of Police, Balasore (opposite party No.3) for redressal of her grievances by filing a grievance petition and the said opposite party be directed to take a decision on such motion within a specific time period.

Considering the submissions made and without // 2 // expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to file a grievance petition before opposite party No.3 through registered post within a period of two weeks from today. In the event, such a petition is filed along with a copy of this order, the opposite party No.3 would do well to take a decision on the same in accordance with law within a period of four weeks from the date of receipt of such grievance petition and communicate the result of such exercise to the petitioner.

Accordingly, this CRLMP is disposed of.

Parties may utilize the soft copy of this order available in the High Court's Website or print out thereof at par with certified copy in the manner prescribed vide Court's Notice No.4587 dated 25.3.2020 read with Notice No.4798 dated 15.04.2021.
