1. This is a petition under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an arbitrator. Ld. Counsel for the petitioner draws the attention of this Court to agreement dated 23.05.2019, wherein the arbitration clause is contained in Clause 8 of the said agreement. She submits that the procedure as envisaged in the said clause was fully followed by the petitioner. Thereafter the arbitration clause was invoked vide letter dated 13.09.2021.
2. She further submits that the petitioner had earlier filed an arbitration petition being ARB.P.631/2022 before this Court. However, the said petition was dismissed as withdrawn vide order dated 24.05.2022 passed by this Court, since as per the ld. Counsel for the petitioner, the relevant prayer clause was missing in the earlier arbitration petition.
