the petitioner.
               Issue notice to the respondents on payment of PF within three working

days by ordinary as well RAD mode failing which the present petitions shall stand dismissed without reference to the court.

Counsel for the petitioner is free to serve humdast notice on the respondent no. 1 for which office is directed to hand over the requisites for humdast service on respondent no 1 who is the the main contesting party, on payment of PF within three working days.

Counsel for the petitioner submits that the defendant's evidence is going on and the case is listed today before the trial court. He has drawn attention of this court to the documents which are required to be filed along with applications before the court. Reply to the application was filed and reason for opposing the the application is delay in filing the application.

He has placed reliance on the orders passed by the court in the cases of Rajkumar vs. Sheikh Joab Ali and Ors. reported in 2018 (2) MPWN 236, Rajendra Singh and Ors. v. Jagdish Singh and Ors. reported in 2015 (3) MPWN 179 and Ram Chandra v. Prem Bai and Ors. reported in 1999 (2) MPLJ 499.

Considering the aforesaid facts and circumstances of the case the trial court is directed to proceed in the matter, however, defendant's witnesses may not be closed till final outcome of the writ petition.

List the matter in the week commencing 16th of September, 2019.
