ORAL JUDGMENT
2 23-02-2015Heard learned counsel for the parties.

Having regard to the nature of allegation against the petitioner of misbehaving with a female colleague in the bank, this Court is not inclined to interfere with the order of suspension, which is only in contemplation of the departmental proceeding. As a matter of fact, a criminal case has also been lodged against the petitioner and, therefore, for the time being, this Court would not find any reason to interfere with the order of suspension.
3. Notwithstanding the aforementioned observations, the bank's rules and regulations will have to be followed because such suspension can not continue for an indefinite period.
4. In that view of the matter, this Court would direct the competent authority of the bank to frame the memo of charge, Patna High Court CWJC No.1183 of 2015 (2) dt.23-02-2015 2/2 if not framed by now, within a period of one month and also proceed to hold departmental enquiry expeditiously so that the enquiry also comes to an end within a period of six months from the date of filing of the written statement of defence by the petitioner to the memo of charge.
5. As with regard to the issue of non-payment of subsistence allowance, as per the Bank's rules and regulations, the petitioner may raise the same before the competent authority and the same will be separately dealt with and disposed of within a period of one month from the date of receipt of a copy of this order.
6. With the aforementioned observation and direction, this writ application is disposed of.
