Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed therewith, the High Court may be
pleased to pleased to issue a Writ, order or direction more particularly

Respondent to change the investigation officer for the FIR in Crime No.382 of
2023 of Cyber Crime Police Station, Visakhapatnam Commissionerate
registered for the offences punishable U/S.354D IPC and pass

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
"...pleased to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 2nd respondent in not concluding the enquiry in respect of my representations dated 16.12.2024, 24.12.2024 and 30.08.2025 for changing of the investigation officer in so far the criminal case is concerned which is registered against me vide FIR in Crime No.382 of 2023 of Cyber Crime Police Station, Visakhapatnam Commissionerate registered for the offences punishable U/S.354D IPC which is highly illegal, arbitrary, unjust, improper, contrary to rules and violation of Article 14 and 21 of the Constitution of India apart from violation of Principles of Natural Justice and consequently direct the 2nd Respondent to change the investigation officer for the FIR in Crime No.382 of 2023 of Cyber Crime Police Station, Visakhapatnam Commissionerate registered for the offences punishable U/S.354D IPC and pass ... 02. Heard Sri Eluru Sesh Mahesh, learned counsel for the petitioner and Sri S.Farooq, learned Assistant Government Pleader for Home.
03. Learned counsel for the petitioner submits that the investigation requires to be transferred to another officer, as the present Investigating Officer had earlier called the petitioner to the police station for settlement of the issue. He would further submit that representations have already been made before the respondent authorities for consideration.
04. Learned Assistant Government Pleader for Home submitted that appropriate orders may be passed by this Court.
05. As seen from the record, the petitioner's representation is still pending before respondent No.2. In that view of the matter, this Writ Petition is 4 disposed of with a direction to respondent No.2 to consider the petitioner's representation and take an appropriate decision in accordance with governing rules and law, within a period of two (2) weeks from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
