                    In the writ petition, the petitioner has prayed for a direction
             upon the authorities of the Kolkata Municipal Corporation to
             implement the order dated 11th December, 1995 passed by the
             Special Officer (Building), Kolkata Municipal Corporation, the
             respondent no. 3, as it is evident from the order dated 26th

October, 2009 that appeal before the learned Municipal Building Tribunal preferred by the person responsible had abated.

Having heard the learned advocates for the parties and in view of the submission made and keeping in mind the order dated 26th October, 2009 passed by the learned Tribunal, the writ petition is disposed of by directing the Kolkata Municipal Corporation and its Municipal Commissioner, the respondent nos. 1 and 2 to implement the order dated 11th December, 1995 passed by the respondent no. 3 within eight weeks from the date of presenting a copy of the certified copy of this order, if there is no order of restraint by any Court of law.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the appearing parties on priority basis.
