                     Prayer:

                                  Petition filed under Article 226 of the Constitution of India to

                     issue a Writ of Mandamus directing the first respondent herein to

                     expeditiously take necessary action to recover the arrears of wages

                     payable to the petitioners as per the common order of the Deputy

                     Commissioner of Labour, Coimbatore, the Appellate Authority under

                     the Payment of Wages Act dated 28.09.1988 in P.W.Nos.52/87, 73/87

                     to 642/87 and 67/88 to 75/88 in accordance with law and further

                     direct the first respondent to take necessary action to ensure

                     expeditious payment of the arrears of wages due to the petitioners

                     together with appropriate interest.

                                                          ORDER

The petitioners have filed this writ petition seeking issuance of Writ of Mandamus directing the first respondent herein to expeditiously take necessary action to recover the arrears of wages payable to the petitioners as per the common order of the Deputy Commissioner of Labour, Coimbatore, the Appellate Authority under the Payment of Wages Act dated 28.09.1988 in P.W.Nos.52/87, 73/87 to 642/87 and 67/88 to 75/88 in accordance with law and further direct the first respondent to take necessary action to ensure expeditious payment of the arrears of wages due to the petitioners together with appropriate interest.

2.The learned Senior Counsel appearing for the petitioners submitted that for implementation of the common order of the Deputy Commissioner of Labour, Coimbatore, the Appellate Authority under the Payment of Wages Act dated 28.09.1988 in P.W.Nos.52/87, 73/87 to 642/87 and 67/88 to 75/88, the present writ petition has been filed. The learned Senior Counsel further submitted that the Joint Commissioner of Labour, Coimbatore has passed an order dated 05.04.2019 in Na.Ka.N Aa3/1734/2019 and prayed that this Court 3/5 https://www.mhc.tn.gov.in/judis ( Uploaded on: 28/05/2025 04:40:07 pm ) W.P.No.25436 of 2019 may, without going into the merits of the case, grant liberty to the petitioners to challenge the order dated 05.04.2019 in the manner known to law.

3.In view of the above, this writ petition is dismissed. Liberty is granted to the petitioners to file appropriate application before the Appellate Authority under the Payment of Wages Act for execution of the common order dated 28.09.1988 in P.W.Nos.52/87, 73/87 to 642/87 and 67/88 to 75/88 or to work out the remedy in the manner known to law. No costs. Consequently, the connected miscellaneous petition is closed.
