Notice on behalf of all opposite parties has been accepted by the learned Chief Standing Counsel.

This Special Appeal has been filed challenging the judgment and order dated 4.2.2021 passed in Writ Petition No. 3271 (SS) of 2021 (Pradeep Kumar Singh v. State of U.P. and others), whereby the writ petition has been disposed of with certain observations by the Writ Court.

Learned Counsel for the appellant-petitioner submits that the appellant-petitioner was not covered under the policy of transfer made by the opposite parties and as such, he could not have been transferred. It is submitted that the son of the appellant-petitioner is handicapped and is undergoing treatment at Sanjay Gandhi Postgraduate Institute of Medial Sciences (SGPGI), Lucknow, as such he could not been transferred in a routine manner.

We have considered his submissions and gone through the record. We feel it appropriate to provide that in case the appellant-petitioner has any grievance against the impugned transfer, which was under challenge in the writ petition, he may make a representation after joining at the transferred place.

Learned Counsel for the appellant-petitioner at this stage informs that he has already joined at the transferred place.

In view of above, in case the appellant-petitioner makes any representation against his transfer to the place of posting, it is expected that the authorities concerned will consider the same and pass appropriate orders, in accordance with law, keeping in mind the guidelines issued for transfer by the department or the State Government, as the case may be.

With these observations, this Special Appeal stands disposed of.
